291 Court brings whose date is the day and year aforesaid acknowledged himselfe to be held and firmly bound unto the said Robert in the aforesaid Sum of Seven pounds nine Shillings and Six pence money aforesaid to be paid to the Said Robert when he Should be thereto afterwards required Nevertheless the said Edmund the said Seven pounds nine Shillings and Six pence (altho' by the said Robert on the first day of March Seventeen hundred and forty two at the County aforesaid and Since) was thereto Required hath not paid but the Same to pay hath hitherto altogether Refused and still doth Refuse whereupon the Same Robert Saith that he is damnified and damage hath to the value of Tenn pounds and thereof he brings Suit &a Pledges de pros Jno Doe & R Roe And the aforesaid Edmund Dickerson by Robert Jenckins Henry his attorney Comes and defends the force and Injury when &.a and Saith that he Cannot deny the action aforesaid of the aforesaid Robert Geddes nor Can he say but that the writing Obligatory aforesaid is the deed of the Same Edmund nor Can he Say but that he Owes the Same Robert the aforesaid Seven pounds nine Shillings and Six pence in manner and form as the aforesaid Robert above against him hath declared &a Therefore it is Considered that the aforesaid Robert Geddes Recover against the aforesaid Edmund Dickerson his debt aforesaid and his damages by Occasion of the detention of the Same debt to 169 pounds of tobacco to the same Edmund of his assent by the Court here adjudged and the aforesaid Edmund Dickerson in Mercy &a
Seven hundred and forty One to answer unto David Wilson of a plea of trespass upon the Case &a and the Same day was given to the aforesaid David there &a And the aforesaid David Complained of the aforesaid Woney in the plea aforesaid in form following Somerset ss.t Woney Macclemey Late of Sommerset County planter was attached to answer unto David Wilson of a plea of trespass upon the Case &.a And whereupon the same David by Robert Jenckins Henry his attorney Complains that whereas the aforesaid Woney after the first day of May in the Year of Our Lord One Thousand seven hundred and five to witt the Twenty Sixth day of November Ann.o Dom One thousand Seven hundred Thirty and nine at Somerset County did make his Certain note in writing Called a promissary note with his proper hand thereunto Subscribed bearing date the Same day and Year Last mentioned and by the Same note did promise to deliver to the Same David Three Thousand five hundred hogshead Staves three feet Eight Inches Long four Inches Broad |
