292 Broad Clear of Sap and three quarters of One Inch upon the heart Edge well Stabled and also five hundred Barrell Staves two feet Eight Inches Long and in wedth and Thickness the Same as the hogshead staves aforesaid both of which said Sorts of Staves every way fitt for the London Markett by the Last of March then next Ensuing at a Landing where Cap.t Tunstalls Sommerset then Lived on Trading Branch the said Wilson procuring Liberty for the aforesaid Staves to be drawn to the aforesaid Landing and by reason thereof as also by Virtue of the Statute in Such Case Lately made and provided the aforesaid Woney became Chargable to deliver unto the sid David the Severall Staves aforesaid according to the Tenor of that note and in Consideration of the premisses the Same Woney upon himselfe did assume and unto the Same David then and there faithfully promise to deliver unto him the said Staves as in the said note Specified And the same David in fact saith that he the said Twenty Sixth day of November in the Year of Our Lord One thousand Seven hundred and thirty Nine did procure Liberty for the aforesaid Staves to be drawn to the aforesaid Landing in the said note mentioned Whereof the same Woney the Same day and Year Last mentioned at Sommerset County aforesaid had notice and altho' the said Woney two Thousand and Sixty five hogshead Staves and Two hundred forty and Seven barrell Staves part of the aforesaid Three Thousand five hundred hogshead Staves and five hundred Barrell Staves in the Same note Contained unto the Same David he hath Since paid and Satisfied Nevertheless as to One thousand four hundred thirty and five hogsheads Staves and two hundred fifty and three Barrell Staves of the aforesaid Three Thousand five hundred hogshead Staves and five hundred Barrell Staves Residue the aforesaid Woney his promise and assumption aforesaid in form aforesaid made Little Regarding but minding and fraudulently Intending the Same David in that part Craftily and Suttlely to deceive and defraud the Same quantity of One Thousand four hundred thirty and five hogshead Staves and Two hundred fifty and three Barrell Staves or any part of either of the Last mentioned quantity unto the Same David (altho' the Same to doe the said Woney on the Last day of March next after the date of the Same note and Often Since that time at Sommerset County aforesaid by the same David requested) hath not paid or delivered but the Same to him to pay or deliver hitherto hath refused and Still doth refuse to the damage of the Same David fifty pounds Currant money of Maryland and thereof he brings suit &a Pledgs de p Jno Doe & R Roe A Copy of the foregoing declaration was made and Sent to be Served on the defend.t in Order for a Speedy Tryall Att which day here Came the aforesaid David Wilson by his attorney aforesaid and the Sheriffe to witt John Handy Gentleman ^now here^ Returned that he had Taken the aforesaid Woney Macclemmey whose body here at this day he had Ready to answer unto the aforesaid David Wilson of the aforesaid plea as to him it was Commanded and |
