291 Order for a Speedy Tryall Att Which day here Came the aforesaid John Wilson by his attorney aforesaid and the Sheriffe to witt John Handy Gentleman now here Returned that he had Taken the aforesaid Philip Owen whose body here at this day he had ready to answer unto the aforesaid John Wilson of the aforesaid Plea as to him it was Commanded and further the Same Sheriffe Returned that he had Served the aforesaid Philip Owen with a Copy of the declaration aforesaid according to act of assembly in Such Case made and provided &a And the said Philip Owen in his proper person Comes and defends the force and Injury when &.a and Saith that he Cannot deny the action aforesaid of the aforesaid John Wilson nor but that he did assume upon himselfe in manner and form as the aforesaid John Wilson above against him Complained and as to the damage of the Same John by him by Occasion of the premisses in that part Sustained the Same Philip saith and acknowledgeth that the aforesaid John has Sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed to four pounds One Shilling and Six pence Currant money of Maryland and not more and becaus the aforesaid Philip denys not this but the Same allegation grants to be true prays Judgmt for those damages above acknowledged together with his Costs and Charges aforesaid to him to be adjudged &.a Therefore by Consent of the parties aforesaid it is Considered that the afd John Wilson Recover against the aforesaid Philip Owen his damages aforesaid to the aforesaid four pounds One Shiling and Six pence Curr.t money of Maryland by the Same Philip in form aforesaid acknowledged 277 as also pounds of tobacco for his Costs and Charges aforesaid at his request by the Court now here of the assent of the parties aforesaid adjudged which Certain damages in the whole amount to four pounds One Shilling and Six pence Currant money of Maryland and pounds of tobacco and the aforesaid Philip in mercy &a
detaines &.a And Whereupon the Same Robert by William Arbuckle his attorney sayth that whereas the said Edmund this day of Anno Dom Seventeen hundred and forty One at Somerset afd by his Certain Writing Obligatory which the Same Robert Sealed with the Seal of the said Edmund hereinto Court |
