290 seven hundred and forty two to answer unto John Wilson of a plea of trespass upon the Case &c and the same day is given to the af.d John here &c And hereupon the said John Complained of the af.d Philip in the plea af.d in form Following Somerset ss.t Philip Owen late of Somerset County planter was Attached to answer unto John Wilson of a plea of trespass upon the Case &c And Whereupon the same John by Robert Jenckins Henry his Attorney Complains that whereas the af.d Phillip the twentyeth day of June in the year of our Lord one thousand seven hundred forty and one at Somerset County was Indebted unto the said John in the sum of Five pounds and sixteen shillings Curr.t money of Maryland and seventeen shillings Curr.t money of the Colony of Virginia of the value of one pound and fourteen shillings Curr.t money of the province of maryland for sundry Articles properly Chargeable in an account as by an account thereof hereinto Court brought may appear and so thereof Indebted being the said Phillip in Consideration thereof afterwards to wit the same day and year af.d at Somerset County af.d upon himself did assume and to the same John then and there faithfully promise that he the said Phillip the severall sums of money af.d unto the same John when thereof afterwards requested he would well and faithfully pay and Content and altho' the af.d Phillip two pounds and two shillings Currt money of maryland part of the af.d five pounds and sixteen shillings unto the same John he hath since paid and stat satisfied Nevertheless as to three pounds fourteen shillings of the said five pounds and sixteen shillings residue and the af.d seventeen shillings Verginia Currency of the value af.d the af.d Phillip his promise and assumption af.d little regarding but minding and fraudulently intending the same John in that part Craftily and suttlely to deceive and defraud the af.d severall sums of three pounds and fourteen shillings Curr.t money of maryland and Seventeen shillings Verginia Currency to the Value af.d or any part of either of the said sums unto the same John he hath not paid or Contented Altho' the same to do the af.d Phillip afterwards to witt the same day and year af.d and often since that time at Sommerset County aforesd was by the Same John requested but the Same to him to pay or Content the Said Philip hath altogether Refused and still doth Refuse to the damage of the Same John Ten pounds Currant money of Maryland and thereof he brings Suit &.a Pledges &.a J Doe & R Roe
Be it Remembred that on the 8.th day of January 1741 Came the above John Wilson and proved the above accot according to act of assembly sworn before me Fr.o Williams A Copy of the foregoing declaration and account were made and Sent to be Served on the defend.t in order |
