290 Whereupon the af.d Benjamin Warrington being present herein Court at the prayer of the af.d Charles Hayman is adjudged to give speciall bail to the Action af.d Thereupon a Certain William English of Somerset County planter present herein Court in his proper person undertook for the said Benjamin Warrington (Likewise the said Benjamin Warrington present herein Court as af.d Assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for him the af.d Charles Hayman against the same Benjamin Warrington or that he the same Benjamin Warrington should be therein Convict that then he the said Benjamin Warrington should pay and satisfie unto the said Charles Hayman the Judgment of the Court thereupon or render his body in Execution of such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the same William English will do the same for him &c And the af.d Benjamin Warrington in his proper person Comes and defends the force and Injury when &c and saith that he Cannot deny the Action af.d of the af.d Charles Hayman nor but that he did assume upon himself in manner and form as the af.d Charles above against him hath Complained and as to the damage of the same Charles by him by Occasion of the premisses in that part sustained the same Benjamin saith and acknowledgeth that the af.d Charles hath sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to two pounds nineteen shillings and Curr.t money of Maryland and not more and because the af.d Charles denys not this but the same Allegation grants to be true prays Judgment for those damages above acknowledged together with his ^Costs &^ Charges af.d to him to be adjudged &c Therefore by Consent of the parties af.d it is Considered that the af.d Charles Hayman recover against the af.d Benjamin Warrington his Damages af.d to the af.d two pounds nineteen shillings Curr.t money of Maryland by the same Benjamin in form af.d Acknowledged as also Three hundred and nineteen 389 pounds of tobacco for his Costs and Charges af.d to the same Charles of his request by the Court now here of the assent of the parties af.d adjudged which Certain Damages in the whole amounts to two pounds nineteen shillings Curr.t money of maryland and: Three hundred and nineteen pounds of tobacco & the af.d Benjamin in mercy &c
