289 trespass upon the Case &c and the same day is given to the af.d Charles there &c And hereupon the said Charles Complained of the af.d Benjamin in the plea af.d in form Following Somerset ss / Benjamin Warrington late of Somerset County Carpenter was Attached to answer unto Charles Hayman of a plea of trespass upon the Case &c And Whereupon the same Charles by Robert Jenckins Henry his Attorney Complains that whereas the af.d Benjamin the fourth day of January in the year of our Lord one thousand seven hundred and forty one at Somerset County was Indebted unto the same Charles in the sum of three pounds and nine shillings Curr.t money of maryland for sundry articles properly Chargeable in an Account as by an Account hereinto Court brought may appear and so thereof Indebted being the same Benjamin in Consideration thereof afterwards to witt the same day and year af.d at Somerset County af.d upon himself did Assume and to the same Charles then and there faithfully promise that he the said Benjamin the said sum of three pounds and nine shillings unto the same Charles ^when thereunto afterwards requested he would well & faithfully pay and Content altho' ye said Benj.n ten shillings part of ye said three pounds & nine shillings unto the same Charles^ he hath since paid and satisfied Nevertheless as to two pounds and nineteen shillings of the af.d three pounds and nine shillings residue the af.d Benjamin his promise and assumption af.d in form af.d made little regarding but minding and fraudulently intending the same Charles in that part Craftily and Suttlely to deceive and defraud the said sum of two pounds and nineteen shillings or any penny thereof unto the same Charles he hath not paid or him for the same Contented Altho' the same to do the said Benjamin afterwards (to witt) the same day and year af.d and often times since at Somerset County af.d by the said Charles was requested) but the same to him to pay or Content hath refused and still doth refuse to the Damage of the same Charles Six pounds Curr.t money of the said province of maryland and thereof he brings suit &c Pledg.s &.c J Doe & R Roe Somerset County
A Copy of the foregoing declaration was made and sent to be served on the Def.t in order for a speedy tryall Att which day here Came the af.d Charles Hayman by his Attorney af.d and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Benjamin Warrington whose body hereat this day he had ready to answer the af.d Charles Hayman of the af.d plea as to him it was Commanded and further the said sheriffe returned that he had served the af.d Benjamin Warrington with a Copy of the foregoing declaration According to Act of Assembly in such Case made and provided &c Whereupon |
