289 thereupon or render his body in Execution of Such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof that he the said William Lane will do the same for him &c And hereupon the said William Rowley declared against the af.d Francis Brooks in the plea af.d in form Following Somerset ss/ Francis Brooks late of Somerset County planter otherwise Called Francis Brooks of the said County was Summoned to answer unto William Rowley of a plea that he render unto him the sum of twenty pounds Curr.t money of Maryland which to him he owes and unjustly detains &c And Whereupon the same William by George Douglas his Attorney says that whereas the af.d Francis the thirtieth day of march in the year of our Lord one thousand seven hundred forty one at Somerset County by his Certain writing obligatory had Granted himself to be held unto the af.d William in the af.d sum of twenty pounds Curr.t money of Maryland to be paid unto the said William when thereunto afterwards he should be required Nevertheless the af.d Francis ^altho'^ tho often required the af.d twenty pounds unto the same William Yet hath not rendred but that unto him to render hath refused and still doth refuse to the Damage of the same William ten pounds Curr.t money af.d and thereupon he brings suit &c and brings hereinto Court the Writing af.d which the Debt af.d in form af.d doth testify the date whereof is the same day and year af.d &c Pledg.s &.c J Doe & R Roe And the af.d Francis Brooks by Robert Jenckins Henry ^his attorney^ Comes and defends the force and Injury when &c and saith that he Cannot deny the action af.d of the af.d William Rowley nor Can he say but that the writing obligatory af.d ^is^ the deed ^of the Same Francis^ nor but that he owes the same William Rowley the af.d twenty pounds Curr.t money of Maryland in manner and form as the af.d William Rowley above against him hath declared &c Therefore it is Considered that the af.d William Rowley recover against the af.d Francis Brooks his debt af.d and his Damages by Occasion of the detention of the same debt to Three hundred and Ninety 368 pounds of tobacco to the same William Rowley of his Assent by the Court here adjudged and the af.d Francis in mercy &c
