             June Court                           1742                       288

as all Costs and Charges accrewing by means of the attachment aforesaid   Whereupon a Certain Robert Jenckins
Henry of Somerset County Gentleman present herein Court in his proper person undertook for the said Day Scot
according to act of assembly in Such Case provided that in Case the said William King should at any time within a year
and a day appear and make all or any part of the said Day Scotts Claim against him appear to be Satisfiyed or
otherwise to have been undue before the Laying of the above attachment that then the said Day Scott shall make
Restitution unto the said William King of all or Such part as shall be so made appear to be undue as aforesaid or that
he the said Robert Jenckins Henry will do the Same for him &a

             Therefore it is Considered by the Court here that the Severall Goods and Chattles so as aforesaid
attached and appeared to the value of Two pounds Six Shillings and five pence Curr.t money of Maryland and
Seven hundred and One pounds of tobacco be Condemned as the proper goods and Chattles of the aforesaid
William King towards Satisfying unto the aforesaid Day Scott the aforesaid Two pounds five Shillings and
Eleven pence Currant money of Maryland and Two hundred and Twenty Six pounds of tobacco as al Costs and Charges
accrewing by means of the attachment aforesaid and that the said Day Scott have thereof Execution according to act
of assembly in Such Case made and provided &a

Command was given to the Sheriffe of Somerset County that he Should Take Francis
Brooks Late of Sommerset County planter otherwise Called Francis Brooks of Said County if
he Should be found in his bailywick and him should safe Keep so that he might have his body before the Justices of his
Lordships County Court of Sommerset to be held at dividing Creek the third Tuesday of June Ann Dom One thousand
Seven hundred and forty Two to answer unto William Rowley of a plea that he Render unto him the Sum of Twenty
pounds Curr.t money of Maryland which to him he owes and unjustly detains &c  and the same day is given to the af.d  
William here &c
                               Att which day here Came the af.d William Rowley by his Attorney af.d and the sheriffe to witt
John Handy Gent now here returned that he had taken the af.d Francis Brooks whose body here at this day he had
ready to answer the af.d William Rowley of the af.d plea as to him it was Commanded

                And hereupon at the prayer of the af.d William Rowley the af.d Francis Brooks is Addjudged to give speciall
bail to the Action af.d     Thereupon a Certain William Lane of Somerset County Gent present herein Court in his
proper person undertook for the said Francis Brooks (Likewise the said Francis Brooks present herein Court in his proper
person Assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for the same
William Rowley against the same Francis Brooks or that he the same Francis Brooks should be therein Convict
that then he the said Francis Brooks should pay and satisfie unto the said William Rowley the Judgment of the Court
