287 that whereas the aforesaid Wilson after the first day of May in the Year of Our Lord One thousand Seven hundred and five to witt the first day of May in the Year of Our Lord One Thousand Seven hundred and forty One at Sommerset County aforesaid did make his Certain note in Writing Called a promissary Note with his proper hand Subscribed bearing date the Same day and Year Last above mentioned and that Note to the same Thomas then and there did deliver by which said note the said Wilson did promise to pay to the Same Thomas or his heirs the full and Just Sum of Two pounds fourteen Shillings and nine pence upon demand for Value received and by reason thereof as allso by virtue of the statute in such Case lately made and provided the same Wilson became Chargeable to pay unto the said Thomas the sum of money af.d According to the tenor of the said note and so thereof Chargeable being the af.d Wilson in Consideration thereof afterwards (to witt) the af.d first day of May in the year of our Lord one thousand seven hundred and forty one at Somerset County af.d upon himself did Assume and to the same Thomas then and there faithfully promise to pay to him the af.d sum of money agreable to the tenor of that note Nevertheless the af.d Willson his promise and assumption af.d made little regarding but minding and fraudulently intending the same Thomas in that part Craftily and Suttlely to deceive and defraud the af.d sum of two pounds fourteen shillings and nine pence or any penny thereof unto the said Thomas altho' the same to do the said Wilson afterwards (to witt) the same day and year last above mentioned and often since that time at Somerset County af.d by the same Thomas was requested hath not paid or him for the same in any sort Contented but the same to him hetherto to pay or Content hath altogether refused and still doth refuse whereupon the same Thomas says he is worse and hath damage to the Value of five pounds Currt money of the province of maryland and thereof he brings Suit &c Pledg.s &c J Doe & R Roe A Copy of the foregoing declaration was made and sent to be served on the def.t in order for a speedy tryall Att which day here Came the af.d Thomas Sanders by his Attorney af.d and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Wilson Dorman whose body hereat this day he had ready to answer the af.d Thomas Sanders of the af.d plea as to him it was Commanded and further the said sheriffe returned that he had served the af.d Wilson Dorman with a Copy of the foregoing declaration According to Act of Assembly im such Case made and provided &c And the af.d Wilson Dorman in his proper person Comes and defends the force and Injury when &c and saith that he Cannot deny the Action af.d of the af.d Thomas Sanders nor but that he did assume upon himself in manner and form as the af.d Thomas above against him hath Complained and as to the Damage of the same Thomas by him by Occasion of the premisses in that part Sustained the same Wilson saith & acknowledgeth that |
