263 one of the other to be Exchanged did award and that the same then and there five pounds Curr.t money of the province of Maryland by the af.d Peter for the Exchange to the af.d James to be paid did adjudge by reason of which the same James and Peter then and there the watches af.d did Exchange and each of them the said James and Peter his Watch af.d to the other of them in Exchange for his Watch af.d According to the agrement af.d did deliver And Whereas also the af.d Peter afterwards (to witt) the twenty sixth day of March in the year of our Lord one thousand seven hundred forty and one at Somerset County af.d was Indebted unto the af.d James in other five pounds like Curr.t money of Maryland for the Exchange of a Certain other watch of the same James for a Certain other Watch of the af.d Peter by the said James with the same Peter before that time had and made according to a Certain agrement thereof between the same James and Peter before that time made and Concluded And so thereof Indebted being the af.d Peter wa afterwards to wit the same twenty Sixth day of March in the year last above mentioned at Somerset County af.d in Consideration thereof upon himself did Assume and to the same James then and there faithfully promise that the af.d Peter the said Five pounds to the same James when thereof afterwards requested he would well and faithfully pay and Content And Whereas also the af.d Peter afterwards (to witt) the same twenty Sixth day of March in the year last above mentioned at Somerset County af.d was Indebted to the af.d James in other five pounds like Curr.t money of Maryland for one other Watch by the af.d James to the same Peter before that time sold and delivered and so thereof Indebted being the af.d Peter afterwards (to witt) the same twenty Sixth day of March in the year last above mentioned at the County af.d in Consideration thereof upon himself did Assume and to the same James then and there faithfully promise that he the af.d Peter the same Five pounds to the same James when thereof afterwards he should be requested well and faithfully would pay and Content Nevertheless the af.d Peter his severall promises and assumptions af.d in form af.d made little regarding but minding and fraudulently intending the same James in that part Craftily and Suttlely to deceive and defraud the af.d severall sums of money or any penny thereof to the same James hath not paid altho' the same to do the af.d Peter afterwards (to witt) the tenth day of Aprill in the year last above mentioned and often times since at Somerset County af.d by the same James requested but the same to him hetherto to pay or in any sort Contented altogrther hath refused and still doth refuse to the Damage of him the said James Ten pounds Curr.t money of the province af.d And thereof he brings Suit &c Pledgs &c J Doe & R Roe And the af.d Peter Taylor by George Douglas his Attorney Comes and defends the force and Injury when |
