263 to them now here given untill next Court to be held at dividing Creek the third Tuesday of November then next following in the same State as at present Saving to the parties aforesaid &a Att which day here Came againe the parties aforesaid by their attorneys aforesaid And hereupon the said James Anderson Complained against the aforesaid Peter of the plea aforesaid in form following Somerset ss Peter Taylor late of Somerset County planter was attached to answer unto James Anderson of a plea of trespass upon the Case &c And Whereupon the same James by Robert Jenckins Henry his Attorney Complains that whereas the twentieth day of November March in the year of our Lord one thousand seven hundred and forty at Somerset County a Certain Communication was had and mov'd between the James and Peter of and Concerning a Certain Watch of him the said James ^and^ of a Certain Watch of him the said Peter ^and^ of the Value of each of the said Watches and also of the Exchanging one of the said Watches for the other to be made upon which said Communication afterwards (to witt) the same twentieth day of March in the year above mentioned at Somerset County it was agreed between the af.d James and Peter that is should be refered to a Certain to Judge of the Exchange of the Watches af.d and of all things to that Exchange relating And that if the af.d the Watches af.d one for the other to Exchange should award then the said James and Peter the Watches af.d to Exchange and each of them the said James and Peter his Watch af.d to the other of them in Exchange for his Watch af.d should Deliver and further that if the af.d any sum of money by either of them the af.d James or Peter for that Exchange to either of them to be paid by the other should adjudged then the other of the af.d James and Peter who any sum of Money should be so adjudged upon ^that^ Occasion to pay unto the other of them that sum according to the same adjudication thereof he would pay And so thereof between them being agreed the af.d Peter afterwards (to witt) the af.d twentyeth day of March in the year above mentioned at Somerset County af.d in Consideration of the agrement af.d and in Consideration that the af.d James at the special Instance and Request of the af.d Peter upon himself did Assume and to the same Peter then and there faithfully promise that he the af.d James the agrement af.d in all things on his part he would perform upon himself did Assume and to the same James then and there faithfully promise that he the af.d Peter that agrement in all things on his part he would perform And the same James in fact saith that the af.d Did take upon them the burthen of ^the^ adjudication of the premisses the same the af.d twentieth day of March in the year af.d at the County af.d the af.d the watches one |
