262 by their attorneys aforesaid and the said Edmund says that he by any thing by the said Thomas in his plea aforesaid prealledged from having and maintaining his action aforesaid against the said Thomas Ought not to be precluded because he says that the said Thomas did not make mould and burn for the said Edmund the quantity of Sixty Thousand good bricks according to Gauge at three Shillings and Six pence p Thousand Country pay and did not begin the first day of august next Ensuing and finish by the first day of October then next Ensuing the date of the said Writing Obligatory according to the force form and Effect of the Condition aforesaid as by his plea aforesaid he hath alledged and this he prays may be Inquired by the Country And the said Thomas Pingally prays Leave thereof to Imparle hereuntill next Court to be held at dividing Creek the third Tuesday of March then next following and he hath it and the same day is given the aforesaid Edmond here also &c Att which day here Came again as well the aforesaid Edmund Hough as the aforesaid Thomas Pingally by their attorneys aforesaid and the said Thomas Relinquisheth his verification aforesaid by him ^first^ above pretended and saith that he Cannot deny the action aforesaid of the aforesaid Edmund Hough nor Can he say but that the writing obligatory af.d is the deed of him the same Thomas Pingally nor but that he owes the same Edmund the af.d twenty one pounds Curr.t money of Maryland in manner and form as the af.d Edmund above against him hath declared &c Therefore it is Considered that the af.d Edmund Hough recover against the af.d Thomas Pingally his debt af.d and his Damages by Occasion of the detention of the same Debt to Six hundred and Seventy Nine 651 pounds of tobacco to the same Edmund of his Assent by the Court here adjudged and the af.d Thomas in mercy &c memorand.m the plantiffe Releaseth all the debt above Save Six pounds and five Shillings Currt money and Cask &a
and forty one to answer unto James Anderson of a plea of trespass upon the Case &c and the same day is given to the James here &c Att which day here Came the aforesaid James Anderson by Robert Jenckins Henry his attorney and the Sheriffe of Sommerset County to witt John Handy Gentleman at the Same day returned that he had Taken the aforesaid Peter Taylor whose body at he had here Ready to to answer the aforesaid James Anderson of the aforesaid plea as to him it was Commanded And Whereupon the said Peter Taylor puts in his place George Douglas Gentleman attorney at Law against the aforesaid James Anderson of the aforesaid plea Whereupon at the request of the parties aforesaid day is to |
