260 say the truth of the premisses af.d together with the other Jurors af.d before Impannelled and sworn being Elected tryed and sworn upon their Oath say that the aforesaid Hugh Rimmor is not Guilty of the premisses in manner and form as the aforesaid Hugh Rimmor above by pleading alledged Therefore it is Considered that the aforesaid Patrick Connelly take nothing by his writt aforesaid but be in mercy for his false Clamour and that the aforesaid Hugh Rimmor goe thereof without day And further it is Considered by the Court that the aforesaid Hugh Rimmor Recover against 786 the aforesaid Patrick Connelly pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same Hugh according to the form of the Statute in Such Case lately made and provided of his assent adjudged and that the afd Hugh have thereof Execution &a
June Anno Dom one thousand seven hundred and forty one to answer unto Sarah Callie of a plea of trespass upon the Case &a and the same day is given to the af.d Sarah here &c And the aforesaid Sarah Chaille Complained of the aforesaid Wheatly Dennis in the plea aforesaid in form following vizt Sommerset County ss Wheatly Dennis Late of Sommerset County planter was attached to answer unto Sarah Challie of a plea of trespass upon the Case &c And Whereupon the said Sarah by Robert Jenckins Henry her Attorney Complains that whereas the said Wheatly whilst he was a Single man and unmarried to witt on the twelfth day of May Anno Dom seventeen hundred and forty at the County of Somerset af.d within the Jur of this Court in Consideration that ^she^ the said SArah then and there being a widow and unmarried at the special Instance and request of the said Wheatly then and there agreed with the said Wheatly and upon herself assumed and to the said Wheatly faithfully promised that she the said Sarah would marry and take the said Wheatly for her husband upon himself assumed and to the said Sarah then and there faithfully promissed that he the said Wheatly would marry and take to wife the said Sarah And altho' the said Sarah giveing faith and Credit to the Assumption of the said Wheatly did altogether refuse to Contract Matrimoney with any other man and as yett remains a widow and unmarried and always from the time of the making of the promise and assumption |
