259 fifty pounds Curr.t money of the province af.d with two Securitys in twenty five pounds like money Each for his good behaviour and appearance at the next Court to be held for the said County at dividing Creek in and for the said County on the third tuesday of August then next Following to answer the said Information and afterwards to witt on the xvij day of March Anno Dom MDCCXL at the County af.d before the said Justices upon the Information af.d pleaded that he was not guilty of the matters and things in the said information against him Charged and thereof put himself on Country and afterwards to wit on the said xvij day of march Anno Dom MDCCXL before the said Justices at the County af.d in a lawfull manner was tryed and acquitted by pretext of all which matters and things the said Patrick Connelly not only in his good name much hurt and damnified is but also sundry sums of money and tobacco by means of the malitious prosecution af.d by the laws and Customes of this province was obliged to pay and also to expend sundry other large sums of money and tobacco in his the said Patricks Defence of the malitious Information af.d Whereupon he says he is damnifyed one hundred pounds Curr.t money of Maryland and thereof he brings Suit &.c Pledg.s &c J Doe & R Roe And the af.d Hugh Rimmer by his Attorney af.d Comes and defends the force and Injury when &c and prayeth Leave thereof to Imparle hereuntill next Court to be held at dividing Creek in and for the County af.d the third Tuesday of March then next Following and he hath it and the same day is given to the af.d Patrick here also &c Att which day here Came again as well the af.d Patrick Connelly as the af.d Hugh Rimmer by their Attorneys af.d and whereupon the af.d Hugh Rimmer as before defends the force and Injury when &c and saith that he is not Guilty of the premisses above upon him imposed as the said Patrick above against him hath Complained and of this he puts himself upon the Country and the said Patrick in like manner Therefore Command is to the Sheriffe of Sommerset County that he Should Cause to Come before the Justices of his Lordships County Court of Sommerset to be held at dividing Creek the third Tuesday of March then next Following Twelve &.a by whom &a and who neither &a to recognize &a because as well &a and the same day is given to the parties aforesaid there &a Att which day here Came againe as well the aforesaid Patrick Connelly as the aforesaid Hugh Rimmer by their attorneys aforesaid and the Jurors of that Jury therein Impannelled being Called some of them (to witt) Joshua Caldwell John Dennis J.r William Jones Edward Rook John Huett Nutter Thomas Purkins Angello Atkinson and William Turpin Came and were sworn upon that Jury and because the residue of the Jurors of that same Jury did not appear Therefore others of the by standers are by the sheriffe of the County af.d Elected and at the request of the af.d Patrick Connelly and by the Command of the af.d Justices are newly putt on whose names to the pannell within Written are affiled according to the form of the statute in such Case made and provided with which same Jurors so newly put on that is to say Thomas Pollitt Edward Chuff Ephraim Waggaman & Dennis Hudson being Called Likewise Came who to say |
