260 Assumption af.d whilst the said Wheatly was a Single man and unmarried was ready and often offered herself to the said Wheatly for her husband Lawfully to Marry and take to witt at Somerset County af.d Nevertheless the said Wheatly whilst he was a single man and unmarried his promise and assumption af.d little regarding but plotting and fraudulently intending her the said Sarah did not part Craftily and Subtilly to deceive and defraud her the said Sarah did not marry and take to wife altho' the same to do the said Wheatly after the promise and assumption af.d made to witt on the seventeenth day of November in the year af.d and often as well before as after at Somerset County af.d by the said Sarah he was thereunto requested but her the said Sarah to marry and take to wife did altogether refuse and afterwards to witt on the twenty fourth day of November af.d in the year af.d at a Certain place Called Accomack County in Virginia to wit at Somerset County af.d did Marry and take to wife a Certain Eliz.a Holland Contrary to the promise and assumption af.d of him the af.d Wheatly Whereupon the said Sarah saith she is worse and hath Damage to the Value of one hundred pounds sterling money and thereupon ^she^ brings Suit &c pledg.s &c J Doe & R Roe A Copy of the foregoing declaration was made and sent to be served on the defendant in order for a speedy tryall Att which day here Came the af.d Sarah Challie by Robert Jenckins Henry her Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Wheatly Dennis whose body her at this day he had ready to answer the af.d Sarah Challie of the af.d plea as to him it was Commanded and further the said sheriffe returned that he had served the af.d Wheatly Dennis with a Copy of the foregoing declaration According to Act of Assembly in such Case made and provided &c Whereupon the af.d Wheatly Dennis being present herein Court at the prayer of the af.d Sarah Challie is adjudged to give speciall bail to the action af.d Thereupon a Certain John Dennis J.r of Somerset County planter present herein Court in his proper person undertook for the said Wheatly Dennis (Likewise the said Wheatly Dennis present herein Court in his proper person assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for her the same Sarah Challie against the same Wheatly Dennis or that he the same Wheatly Dennis should be therein Convict that then he the said Wheatly Dennis should pay and satisfie unto the said Sarah Challie the Judgment of the Court thereupon or render his body in Execution of such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the said John Dennis J.r will do the same for him &c Ands the af.d Wheatly Dennis by ^George Douglas^ his Attorney af.d Comes and defends the force and Injury when &c and prayeth Leave thereof to Imparle hereuntill next Court to be held at dividing Creek ^in & for the County af.d^ the third Tuesday of August then |
