And Whereupon the same Denton by Robert Jenckins Henry his Attorney says that whereas the af.d Patrick the XX day of August in the year of our Lord one thousand seven hundred and forty at Somerset County by his Certain Writing obligatory did grant himself to be held and firmly bound to the said Denton in the af.d Eighteen pounds Eight shillings money af.d to be paid to the said Denton when thereof he should be requested Nevertheless the said Patrick altho' often required the af.d Eighteen pounds Eight shillings unto the same Denton he hath not rendred but the same to him hitherto to render hath refused and still doth refuse Whereupon he says he is worse and hath damage to the Value of thirty pounds Curr.t money af.d and thereof he brings suit &c And brings hereinto Court the writing af.d which the debt af.d in form af.d doth testifye the date of which is the same day and year af.d &c Pledg.s &c J Doe & R Roe And the af.d Patrick Connelly by Geo Douglas his Attorney Comes and defends the force and Injury when &c and saith that he Can not deny the action af.d of the af.d Denton Carroll nor Can he say but that the writing obligatory af.d is the deed of the same Patrick nor but that he owes the same Denton the af.d Eighteen pounds Eighteen shillings Curr.t money of Maryland in manner and form as the af.d Denton above against him hath declared &c Therefore it is Considered that the af.d Denton Carroll recover against the af.d Patrick Connelly his debt af.d and his damages by Occasion of the detention of the same debt to 272 pounds of tobacco to the same Denton by the Court here of his assent by the Court here adjudged and the af.d Patrick in mercy &c
And Whereupon the same Thomas by Robert Jenckins Henry his attorney says that whereas the aforesaid Stephen the fourth day of March in the Year of Our Lord One Thousand Seven hundred and forty One at Sommerset County by his Certain Writing Obligatory did grant himselfe to be held and firmly bound to the said Thomas in the aforesaid Sum of One hundred pounds Currant money aforesaid to be paid to the said Thomas when thereof he should be requested Nevertheless the Said Stephen altho' often requested the aforesaid One hundred pounds unto the Same Thomas he hath not Rendred but the Same to him hitherto to render hath refused and Still doth refuse whereupon he Says he is the worse and hath damage to the value of One hundred pounds Curr.t money of Maryland and thereof he brings his Suit &.c and brings hereinto Court the writing afd which the debt afd in form afd doth Testify |
