272                                                    pounds of tobacco to the Same Denton by the Court here of his assent by
the Court adjudged and the afd William in Mercy &c

WA  Caleb Bevins
Somerset ss/    Caleb Beavins late of Somerset County planter otherwise Called Caleb
Beavins of Somerset County in the province of Maryland planter was summoned to
answer unto William Murray and Thomas Airey of a plea that he render unto them
Eleven pound ten shillings and Eleven pence half penny Curr.t money of Maryland
    which to them he owes and unjustly Detains

                                  And Whereupon the same William and Thomas by Francis Allen their Attorney
says that whereas the said Caleb on the twenty first day of april Anno Dom MDCCXXXIX at Somerset County
af.d by his Certain writing obligatory which the same William and Thomas sealed with the seal of the af.d
Caleb hereinto Court bring whose date is the day and year af.d acknowledged himself to be held and firmly
bound unto the same William and Thomas in the said Sum of Eleven pounds ten shillings and Eleven pence
half money af.d to be paid to the said William and Thomas when he should be thereto afterwards required
Nevertheless the said Caleb the said sum of Eleven pounds ten shillings and Eleven pence half penny
money af.d to the same William and Thomas altho' by them often required hath not paid but the same to pay
hath hitherto denyed and still doth deny  Whereupon the same William and Thomas say they are
damnified and Damage hath to the Value of Eleven pounds ten shillings and Eleven pence half penny
money af.d and thereof they bring suit &c                                                         Pledg.s J Doe & R Roe

                               And the af.d Caleb Beavins by William Arbuckle his Attorney Comes and defends
the force and Injury when &c and saith that he Cannot deny the action af.d of the af.d William Murray
and Thomas Airey nor Can he say but that the Writing Obligatory af.d is the deed of the same Caleb nor but
that he owes the same William and Thomas the af.d Eleven pounds ten shillings and Eleven pence half
penny Curr.t money of Maryland in manner and form as the af.d William and Thomas above against him
hath declared &c

                               Therefore it is Considered that the af.d William Murray and Thomas Airey recover
against the af.d Caleb Beavins their debt af.d and their damages by Occasion of the detention of the same
debt to One hundred and Ninety Seven pounds of tobacco to the same William and Thomas by
the Court here of their assent by the Court adjudged and the af.d Caleb in Mercy &c
