                  Came Cap.t Henry Lowes and maid oath
on the holy evengelest of Almighty God that the
within Acc.t is Just and true as it stands stated and
that he hath not directly nor Indirectly Rec.d and
any part or percell thereof nor taken any Security or
Satisfaction for the same more then the Credit Given
                   Before Tho.s Gillisse


And the said Francis Allen ^Jun^ by his attorney afd
Cometh and defendeth the force and Injury when &
and prayeth leave thereof to Imparle here untill
next Court to be held at dividing Creek the third Tuesday
of August then next Following and he hath it and the
same day is given to the af.d Henry here also &c

       Att which day here Came againe as well the aforesaid Henry Lowes as the aforesaid Francis Allen
Jun.r by their attorneys aforesaid  And whereupon the said Henry prays that the aforesaid Francis to his
declaration aforesaid may answer but the said Francis altho Solemnly Called Came not nor says nothing in
barr or preclusion of the action aforesaid of the aforesaid Henry by which the same Henry remains against the afd
Francis thereof undefended &a      For which reason the same Henry his damages by Occasion of the non
performance of the promise and assumption afd against the aforesaid Francis Ought to recover but because it
