25 is not Known what damages the aforesaid Henry hath Sustained by Occasion of the non performance of the promise and assumption aforesaid Therefore it is Commanded the Sheriffe of the County aforesaid that by the Oath of honest and Lawfull men of his Bailywick he diligently Inquire what damages the aforesaid Henry has Sustained as well by Occasion of the non performance of the promise and assumption aforesaid as for his Costs and Charges by him about his Suit in this part apposed and the Inquisition which thereupon he takes to the Justices of his Lordships County Court of Somerset to be held at dividing Creek in and for the County afd the third Tuesday of November then next following under his Seal and the Seal of them by whose Oath he takes that Same Inquisition he said together with the writt to him thereof directed and the same day is given to the afd Francis there &a
body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the same County the third Tuesday of June Anno Dom one thousand seven hundred and forty to answer unto Dunken Murray of a plea of trespass upon the Case &a and the same day is given to the af.d Dunken here &c Att which day here Came the af.d Dunken Murray by Robert Jenckins Henry his Attonrey and the sheriff to witt John Henry Gent now here returned that he had taken the af.d Edmond Crapper whose body here at this day he had ready to answer the af.d Dunken Murray of the af.d plea as to him it was Commanded And hereupon the said Edmond Crapper puts in his place William Arbuckle Gent Attorney at Law against the af.d Dunken Murray of the af.d plea Whereupon at the request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek the third tuesday of August then next Following in the same state as at present saveing to the parties af.d Att which day here Came againe as well the aforesaid Dunken Murray as the aforesaid Edmond Crapper Jun by their attorneys aforesaid And whereupon the aforesaid Dunken who offered the writt aforesaid against the aforesaid Edmond Crapper Jun of the aforesaid plea did not prosecute the same writt Therefore he and his pledges of prosecuting are in mercy and let the plantiffe name pledges &.a And that the aforesaid Edmond Crapper Jun Administrator of the aforesaid Godfrey Sprogles goe thereof without day Also it is Considered that the aforesaid Edmond Crapper ^Jun^ recover against the aforesaid 149 Dunken Murray his damages by Occasion of the premisses to One hundred and Seventy One pounds of tobacco to the same Edmond by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute in Such Case Lately made and provided by the Court here adjudged &a
