247 pounds of pork in manner and form as the af.d John Atkinson above against him hath declared Therefore it is Considered that the af.d John Atkinson recover against the af.d Mathias Nicholson his debt 257 af.d and his damages by Occasion of the detention of the same debt to Two hundred and fifty seven pounds of tobacco to the same John Atkinson of his Assent by the Court here adjudged and the af.d Mathias in mercy &c
and forty one to answer unto Day Scott of a plea of trespass upon the Case &c and the same day is given to the af.d Day here &c Att which day here Came the af.d Day SCott by his Attorney af.d ^Robert Jenckins Henry^ and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d William King whose body here at this day he had ready to answer the af.d Day Scott of the af.d plea as to him it was Commanded And the said Day Scott Complained of the af.d William King in the plea af.d in form Following Somerset ss.t William King late of Somerset County Inholder was attached to answer unto Day Scott of a plea of trespass upon the Case &c And Whereupon the same Day by Robert Jenckins Henry his Attorney Complains that whereas the said William the seventeenth day of January in the year of our Lord one thousand seven hundred and forty one at Somerset County was Indebted unto the same Day in the sum of four pounds two shillings and Eight pence Curr.t money of Maryland for Sundry goods wares and merchandizes by the same Day to the said William at his request special Instance and request before that time sold and delivered and so thereof Indebted being the said Day afterwards (to witt) the same day and year af.d in the County af.d in Consideration thereof upon himself did Assume and to the same Day faithfully promise that he the said William the af.d four pounds two shillings and Eight pence unto the same Day when thereto afterwards requested would well and faithfully pay and Content and altho' the aforesaid William One pound Sixteen Shillings and nine pence part of the aforesaid Four pounds two Shillings and Eight pence he hath Since paid and Satisfied Nevertheless the aforesaid William as to Two pounds five Shillings and Eleven pence of the said four pounds Two Shillings and Eight pence Residue his promise and assumption afd in form aforesaid made Little Regarding but plotting and fraudulently Intending the Same day in that part Craftilly and Subtilly to deceive and defraud the said Sum of Two pounds five Shillings and Eleven pence or any penny thereof (altho' the Same to do the aforesaid William afterwards to witt the Same day and Year afd and Often Since at Since at Sommerset County afd by the said Day was Requested unto |
