247 thereupon James Anderson Garnishe as aforesaid appears and Imparles &.c untill June Court then next following
County Court of Sommerset to be held at dividing Creek the third Tuesday of March Ann Dom One thousand Seven hundred and forty One to answer unto John Atkinson of a plea that he Render unto him One Thousand and ninety two pounds of good pork neatly Cleared at Snow Hill which from him he unjustly detaines &c and the same day is given to the aforesaid John here &c And hereupon the said John declared against the afd Mathias in the plea aforesaid in form following viz.t Sommerset ss Mathias Nicholls Late of Sommerset County planter al.s dict.s Mathias Nicholson whellwright of Sumersett in the province of Maryland was Summoned to answer unto John Atkinson of a plea that he Render unto him One thousand and ninety Two pounds of good pork neatly Cleaned at snow hill which from him he unjustly detains &c And Whereupon the sid John by Francis Allen his Attorney saith that whereas the said Mathias the sixth day of May Anno Dom one thousand seven hundred and forty one at the County of Somerset af.d within the Jur of this Court by his Certain writing obligatory with which the said John with the seal of the said Mathias signed hereinto Court brings the date whereof is the same day and year did Acknowledged himself to be bound unto the said John in the af.d one thousand and ninety two pounds of good pork neatly Cleaned to be paid unto the said John when he should be thereunto required yett the said Mathias tho' often required the said one thousand and ninety two pounds of pork neatly Cleaned to the said John hath not rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detain Whereupon he saith he is worse and hath damage to the value of tenn pounds Curr.t money of maryland and thereof he brings suit &c Pledg.s &.c J Doe & R Roe A Copy of the foregoing declaration was made and sent to be served on the defendant in order for a speedy tryall Att which day here Came the af.d John Atkinson by his Attorney af.d and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Matias Nicholson whose body here at this day he had ready to answer the af.d John Atkinson of the af.d plea as to him it was Commanded and further the said sheriffe returned that he had served the af.d Mathias Nicholson with a Copy of the foregoing declaration according to Act of Assembly in such Case provided &.c And the af.d Mathias Nicholson in his proper person Cometh and defendeth the force and Injury when &c and saith that he Cannot deny the action af.d of the af.d John Atkinson nor but that the writing obligatory af.d is the Dee of ^him^ the same Mathias Nicholson nor but that he owes ^the same^ John Atkinson the af.d one thousand and ninety two pounds |
