246 March 1 1741/2 Inventory of Goods and Chattles of Henry Reynolds appraised in Curr.t money of Maryland at the suit of Coll Levin Gale by us vizt one old negro woman Dynah £3..0..0 one Dubel Loone 7..2 6 Isaac Handy Tho.s Walker And Whereupon the aforesaid Benjamin Sharpe Garnishee as aforesaid in his proper person Comes and saith that he Cannot deny but that he has of the Rights and Credits of the aforesaid Henry Reynolds to the Value of five pounds Currant money of Maryland nor Can he Say but that the Same Ought to be Condemned in his hands for the Use of the said Levin Gale as of the Rights and Credits of the said Henry Reynolds which the said Levin Gale doth not gainsay Likewise the said Henry Reynolds altho' Solemnly Called Came not nor Shews Cause why &c but made default &.c Whereupon the aforesaid Levin Gale by his attorney aforesaid prays that upon giveing Security according to act of assembly in Such Case made and provided that the afd five pounds Curr.t money of Maryland so as afd Confessed by the aforesaid Benjamin Sharpe and the Severall goods and Chattles so as afd attached and Valued to Twenty Nine pounds three Shillings and Six pence Curr.t money of Maryland as of the goods and Chattles Rights and Credits of the aforesaid Henry Reynolds may be Condemned towards Satisfying unto the said Levin Gale his damages and all Costs and Charges accrewing by means of the attachment aforesaid &a Thereupon a Certain Robert Jenckins Henry of Sommerset County Gent present here in Court in his proper person undertook for the aforesaid Levin Gale according to act of assembly in Such Case made and provided that in Case the said Henry Reynolds do at any time within a year and a day appear and make all or any part of the said Levin Gales Claim against him appear to be Satisfied or otherwise to have been undue before the Laying of this attachment that then the said Levin Gale shall make restitution unto the said Henry Reynolds of all or Such part as shall be so made appear to be undue as afd or that he the sid Robert Jenckins Henry will do the Same for him &c Therefore it is Considered by the Court here that the aforesaid Sum of five pounds Currant money of Maryland part of the Sum so as afd attached and acknowledged by the afd Benjamin Sharpe be Condemned in the hands of the afd Benjamin Sharpe as of the Rights and Credits of the afd Henry Reynolds towards Satisfying unto the afd Levin Gale his damages and all Costs and Charges accrewing by means of the attachmt afd and that the afd Levin Gale have thereof Ex.n against the afd Benja Sharpe according to act of assembly &c Also it is Considered by the Court here that the Severall goods and Chattles so as aforesaid attached and valued to Twenty nine pounds three Shillings and Six pence Currant money ^of Maryland^ be Condemned as the proper goods and Chattles of the afd Henry Reynolds towards Satisfying unto the aforesaid Levin Gale his damages and all Costs and Charges accrewing by means of the attachmt afd and that the afd Levin Gale have thereof Execution &c thereupon |
