23 the same William in the same County Court of the afd Lord proprietary that now is were adjudged for his Costs and Charges by him about his defence in that part sustained whereof he is Convict as by the Records and proceedings thereof in the County Court af.d reviewing remaining fully and manefestly doth appear which said Judgment still remains in full force and effect and in no sort Reversed vacated Anulled or Satisfied and the same William Execution of same Judgment hath not as yet obtained by which Action hath accrued to the same William to demand and have of the af.d Benjamin the af.d eight hundred ninety and two pounds of tobacco Nevertheless the same Benjamin altho often requested the af.d Benjamin the eight hundred and ninety two pounds of tobacco to the said William he hath not as yet rendred but the same to him hetherto to render altogether hath refused and still doth refuse Whereupon he says he is worse and hath damage to the value of two thousand pounds of tobacco and thereof he brings suit &.a Pledges &.a J Doe & R Roe And the aforesaid Benjamin Sharp in his proper person Come and defaced the force and Injury when &.a And thereupon at the prayer of the aforesaid William the aforesaid Benjamin is adjudged to give speciall bail to the action aforesaid but for want thereof the said Benjamin is Committed into the Custody of the Sheriffe of the County afd there to remaine untill next Court to be held at dividing Creek the third Tuesday of August then next following and the same day is given to the afd William here also &a Att which day here Came againe as well the aforesaid William Gray by his attorney aforesaid as the afd Benjamin Sharp in his proper person in Custody of the Sheriffe of the County aforesaid and thereupon the said Benjn saith that he Cannot deny the action aforesaid of the aforesaid William Gray nor Can he say but that he oweth the aforesaid William the aforesaid Eight hundred and ninety two pounds of tobacco in manner and form as the aforesaid William above against him hath declared Whereupon the af.d Benjamin Sharp by the assent of the af.d William Gray is discharged from the Committment af.d &.a Therefore it is Considered that the af.d William Gray Recover against the af.d Benjamin Sharp his debt af.d and his damages by Occasion of the detaining of the same 244 debt to pounds of tobacco to the same William Gray of his assent by the Court here adjudged and the af.d Benjamin Sharp in mercy &.a |
