thousand seven hundred and forty one before his said Lordships Justices the peace in the County af.d to keep Assigned by the oath of twelve Jurors presented that Donnock Dennis late of all hallows parish in the said County of Somerset planter the Sixteenth day september in the year of our Lord one thousand seven hundred and forty one with force and Arms at the parish af.d within the County af.d within the Jurisdiction of this Court in and upon a Certain Samuel Davis in the peace of God and the same Lord propry then and there being an Assault did make and him the said Samuel Davis then and there did beat wound and evilly treat so that of his life it was greatly dispaired and other harms to him then and there did to the Grievous damage of him the said Samuel and Contrary to the peace of the said Lord propry that now is his good rule and Government &c Thereupon Command was given to the sheriffe of Somerset County that he should Take ^the said^ Donnock Dennis if she should be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of March Anno Dom one thousand seven hundred and forty one to answer unto his said Lordship of the Indictment af.d &c And now to witt the third Tuesday of March Ann Dom One thousand Seven hundred and Forty One at a Court then held at dividing Creek before his Lordships Justices Came the afd Donnock Dennis in his proper person and had a hearing of the Indictm.t afd and saith that he will not plead with his said Lordship but Submits with a protestation of his Innocency and puts himselfe upon the favour of the Court &c Whereupon all and Singular the premisses being see and by the Court here fully understood It is Considered by the Court here that the af.d Donnock Dennis pay unto his ^said^ Lordship the right Honrble the Lord propry of the province of Maryland for his fine by the Court here upon him Imposed for and by Ocasion of the premisses af.d whereof in form af.d he is Convict five shillings Curr.t money of maryland and that the said Donnock Dennis be be taken to satisfie his said Lordship of the fine af.d &c Whereupon the said Donnock Dennis is ordered to give security for the payment of all fee or fees due on the Indictment af.d to any person or persons what soever Thereupon Joshua Sturges and William Jarman both of Somerset County planters present herein Court in their proper persons undertook for the said Donnock Dennis |
