day of the same month Anno Dom one thousand seven hundred and forty one before his said Lordships Justices the peace in the County af.d to keep assigned by the oath of twelve Jurors presented that Comfort Blake late of all hallows parish in the said County of Somerset spinster the thirtieth day of November In the year of our Lord one thousand seven hundred and forty at the parish af.d in the County af.d within the Jurisdiction of this Court did Commit fornication with a Certain person to the Jurors af.d unknown and did permit the same unknown person then and there to have Carnal knowledge of her body and then and there to beget a bastard Child on the body of her the same Comfort to the high displeasure of allmighty God to the evill Example of all others in such Case offending Contrary to the peace of the same Lord propry that now his good rule and Government and against the form of the Act of Assembly in such Case made and provided &c Thereupon Command was given to the sheriffe of Somerset County that he should take the said Comfort Blake if she should be found in his bailywick and her should safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at Dividing Creek the third Tuesday of March Anno Dom one thousand seven hundred and forty one to answer unto his said Lordship of the Indictment af.d &c Att which day here before his Lordships Justices Came the aforesaid Comfort Black in her proper person and had an hearing of the Indictment aforesaid and thereupon it is is said by the Court here unto Robert Jenckins Henry Gent who for his said Lordship in this part prosecuteth that he noe farther prosecute against the aforesaid Comfort Blake of and upon the fornication aforesaid Whereupon the said Robert Jenckins Henry Gent who &c present herein Court in his proper person saith that he will noe further prosecute against the afd Comfort Blake of and for the fornication af.d And upon this the aforesaid Comfort Black prays Judgmt of and upon the premisses afd Whereupon all and Singular the premisses being seen and by the Court here fully understood and mature deliberation thereupon had It is Considered by the Court here that the afd Comfort Blake as to the fornication afd goe at present without day Saving ever the Right of his Lordship &a Whereupon the said Comfort Blake is ordered to give Security for the payment of all fees due on the Indictment af.d to any person or persons whatsoever Thereupon John Fasit of Somerset County planter present herein Court in his proper person undertook for the said Comfort Blake to pay all fee or fees due to any person or persons whatsoever on the Indictment af.d In case that the said Comfort Blake doth not pay the same &c |
