229 seven hundred and forty one before his said Lordships Justices the peace in the County af.d to keep Assigned by the oath of twelve Jurors being presented that David Smith late of Stepney parish in the said County of Somerset planter the first day of September in the year of our Lord of our Lord one thousand seven hundred and forty at the parish af.d in the County af.d within the Jurisdiction of this Court did Commit fornication with a Certain Eliz.a Kelley and of her body then and there had Carnal Knowledge and a bastard Child on the body of her the same Elizabeth then and there did beget to the high displeasure of Almighty God to the evill example of all others in such Case offending Contrary to the peace of the right Honourable the Lord propry that now is his good rule and Government and against the form of the Act of Assembly in such Case provided Thereupon Command was given to the Sheriffe of the County of Sommerset that he Should Take the said David Smith if he should be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of March Anno Dom one thousand seven hundred and forty one to answer unto his said Lordship of the Indictment af.d &a And now to witt at a Court held for the County af.d the third Tuesday of March being the Sixteenth day of the same month and Anno Dom one thousand seven hundred and forty one before his said Lordships Justices at Dividing Creek Came the af.d David Smith in his proper person and had a hearing of the Indictment af.d and saith that he Cannot deny but that he is guilty of the premisses af.d in the Indictment af.d Specefyed in manner and form as by the Indictment af.d above against him Supposed and the premisses in the Indictment af.d Expressly Acknowledged Whereupon all and Singular the premisses being seen and by the Court here fully understood It is Considered by the Court here that the af.d David Smith pay unto his Lordship the Right Honrble the Lord propry of Maryland for his fine by the Court hereupon him Imposed for and by Occasion of the premisses af.d whereof in form af.d he is Convict thirty shillings Curr.t money of Maryland and that the said David Smith be taken to satisfie his said Lordship of the fine af.d &c Whereupon the said David Smith is ordered to give Security to save and keep Indemnified the Justices of the County of Somerset and their Successors from all troubles burthens and Charges that might accrew by means of the birth and maintainance and bring^ing^ up of the Child af.d &c Thereupon the said David smith with John Tatman of Somerset County planter present herein Court in his proper person Acknowledged themselves Indebted unto his Lordship the right Honrble the Lord propry of the province of Maryland in thirty pounds Curr.t money of their bodys goods or Chattles lands or tenements Severally |
