229 And now to witt the third Tuesday of March being the Sixteenth day of the same month Anno Dom one thousand seven hundred and forty one at a Court then held before his Lordships Justices at dividing Creek in and for the County of Somerset Came John Scarbrough and ^Mr^ Edm.d Hough two of the Gentlemen nominated in the above Commission and made return thereof endorsed with the Severall depositions thereto annexed in form Following Oc.t 6.th 1741 Came Cap.t John Scarbrough and ^M.r^ Edm.d Hough two of the Commissioners within named and was duely Qualifyed to Execute the within Commission as the Law directs Sworn before Jam.s Martin The Execution of the within Commission appears by a Certain Schedule hereunto annexed Somerset County ss/ By Virtue of a Commission to us directed bearing date the 26th of November 1740 to examine Evidences in relation to the bounders of two tracts of Land lying in the County af.d the one Called Grove the other Castle quarter on behalfe of a Certain Hugh Stevenson of the County af.d Wee the Subscribers being Quallified have appointed a day as the Law directs and have mett on the af.d Land and there Caused to Come before in this 10.th of march 1741/2 Ephraim Heather aged Seventy three Years or there abouts being sworn on the holy Evangelist of almighty God do say that the forked white Oak standing on the south side of a branch Commonly known and Called George Trewitts branch and up the said branch and above M.r Stevensons plantation about a quarter of a mile it being the first bounder of of Grove and the said Heather was shewed a Live oak by M.r Davise standing in a branch a Little above the main Road that Leads from Snowhill upwards a Cross the said branch and the said Heather Carried us to a Little Old field Called Hooks field and showed a stump where now is fixed a sassafras Post notched with four notches on each side that is to say Sixteen notches and that he was showed the tree were now the Sassafras post stands by John Miller at the Request of M.r Davise forty years agoe and further saith not George Truit aged fifty years or there abouts being sworn on the holy Evangelist of almighty God do say that the above mentioned forked white oak standing as before mentioned is the first bounder of the Land Called Grove and further saith not This taken before us Jno Scarbrough (seal) Edm Hough (seal)
