218 And the said Thomas Butler in his proper person Comes and defends the force and Injury when &c and saith that he Cannot deny the Action af.d of the af.d Patrick Connelly nor but that he did Assume upon himselfe in manner and form as the af.d Patrick Connelly above against him hath Complained and as to the damage of the same Patrick by him by Occasion of the premisses in that part Sustained the same Thomas Butler saith and acknowledgeth that the af.d Patrick hath Sustained damages by occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed ^to^ three pounds five shillings Curr.t money of Maryland and not more and because the af.d Patrick denys not this but the same Allegation Grants to be true prays Judgment for those damages above Acknowledged together with his Costs and Charges af.d to him to be Adjudged &c Therefore by Consent of the parties af.d it is Considered that the af.d Patrick Connelly recover against the af.d Thomas Butler his damages af.d to the af.d three pounds five shillings Curr.t money of Maryland by the same Thomas in 226 form af.d Acknowledged as also Two hundred and forty Eight pounds of tobacco for his Costs and Charges af.d to the same Patrick at his request by the Court now here of the Assent of the parties af.d adjudged which Certain damages in the whole amounts to three pounds five shillings Curr.t money of Maryland and Two hundred and forty Eight pounds of tobacco and the af.d Thomas in mercy &c Ordered that Isaac Handy and Mitchell Dashiell of Sommerset County Gentleman Lay out and direct Thomas Covington Overseer for the Clearing of a new Road from the foot of the Causway that Leads from the Bridge (that M.r John Caldwell hath built Over wickacomoco River at Solsbury Town) on the west side of the said River into the main Road or Rockawakin and so Over Rockawakin Mill branch in to the main Road that Leads to Capt John Handys ferry And from the foot of the said Causway into the main Road that Leads to Spring hill Chappell &c Ordered that George Dashiell of Sommerset County Gentleman Lay out and direct Lewis Disharoon Overseer of the Roads on the East side of Wickacomoco River ^for the Clearing of a road^ from Mr Caldwells mill damm to the foot of the aforesaid Bridge and from the foot of the afd Bridge into the main Road that Leads Round the head of the afd River &a Ordered that Thomas Linsey of Sommerset County planter be allowed (for the keeping and finding a Certain Mary Griffin a poor Object provision and Cloathing and all other necessarys sufficient for such an Object to have and wear) Seven pounds Currant money of Maryland p year &a Ordered that Capt Henry Ballard pay unto Capt Robert Jones four pounds Currt money out of the fines due from the County afd towards Cloathing of W.m Dixon an Object &c Ordered that Capt Henry Ballard pay unto John Campbell on account of John Bains an Object and he to be allowed for the same next Levy Court &c |
