218 County Court for the time being as also the Inhabitants of said County of and from all Costs Charges and burthens whatsoever for or by reason of the birth maintainance whatsoever touching or Concerning of the same &c
Tuesday of November Anno Dom one thousand seven hundred and forty one to answer unto Patrick Connelly of a plea of trespass upon the Case &c and the same day is given to the af.d Patrick here &c Att which day here Came the af.d Patrick Connelly by Robert Jenckins Henry his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Thomas Butler whose body here at this day he had ready to answer the af.d Patrick Connelly of the af.d plea as to him it was Commanded And hereupon the said Patrick Connelly Complained of the af.d Thomas Butler in the plea af.d in form Following Somerset ss/ Thomas Butler late ofd Somerset County planter was Attached to Answer unto Patrick Connelly of a plea of trespass upon the Case &c And Whereupon the same Patrick by Robert Jenckins Henry his Attorney Complains that whereas the af.d Thomas the tenth day of may in the year of our Lord one thousand seven hundred forty and one at Somerset County was Indebted unto the same Patrick in the sum of three pounds and five shillings Curr.t money of the province of Maryland for Sundry goods and merchandizes by the same Patrick to the said Thomas at the special Instance and request of the same Thomas before that time sold and delivered and so thereof Indebted being the af.d Thomas in Consideration thereof afterwards (to witt) the same day and year af.d at the County af.d upon himself did Assume and to the same Patrick then and there faithfully promise that he the said Thomas the said sum of three pounds and five shillings unto the same Patrick when thereof afterwards requested would well and faithfully pay and Content Nevertheless the af.d Thomas his promise and Assumption af.d in form af.d made little regarding but minding and fraudulently intending the same Patrick in that part Craftily and Suttlely to deceive and defraud the said sum of three pounds and five shillings or any penny thereof unto the same Patrick he hath not paid (Altho' the same to do the af.d Thomas afterwards (to witt) the same day and year af.d and often since that time at Somerset County af.d by the same Patrick requested ^but the same to him to pay or Content the af Thomas hitherto^ hath refused and still doth refuse to the damage of the same Patrick Seven pounds Currt money af.d and thereof he brings Suit &c Pledg.s &.c J Doe & R Roe And |
