217 the Court here to understand and be Informed that Gamage Evans late of All hallows parish in the said County of Somerset planter the tenth day of Febry in the year of our Lord one thousand seven hundred and forty at the parish af.d in the County af.d within the Jurisdiction of this Court did Commit Adultery with a Certain Rachell Barnet he the said Gamage Evans then and there being a Maried man and of her body then and there had Carnal knowledge and a bastard Child on the body of her the same Rachel then and there did beget to the high displeasure of Almighty God to the evill example of all others in such Case offending Contrary to the ^peace of the^ right Honourable the Lord proprietary that now is his good rule and Government and against the form of the Act of Assembly in such Case lately made and provided &c Whereupon the same Attorney of the same Lord proprietary for the same Lord ^proprietary^ prays the Advice of the Court herein the premisses and that due process of Law in this part against the same Gamage Evans may be made to answer unto the same Lord proprietary of and upon the premisses &c Thereupon Command was given to the Sheriffe of Somerset County that he should take the said Gamage Evans if he should be found in his bailywick and him should safe keep so that he might have his body here Immediately before ^the^ Justices of his Lordships County Court of SOmerset now Sitting at dividing Creek to Answer unto his said Lordship of the Information &c And afterwards to witt the same day and year above mentioned Came here before his Lordships Justices the said Gamage Evans in his proper person and had a hearing of the Information af.d and saith that he Cannot deny but that he is Guilty of the premisses af.d in the Information af.d Specified above upon him Imposed in manner and form as by the Information af.d above against him Supposed and the premisses in the Information af.d Expressly Acknowledgeth Whereupon all and Singular the premisses being seen and by the Court here fully understood It is Considered by the Court here that the af.d Gamage Evans pay unto his said Lordship the right Honourable Charles Absolute Lord and proprietary of Maryland for his fine by the Court here upon him Imposed for and by Occasion of the premisses af.d whereof he is Convict three pounds Curr.t money of Maryland and that the said Gamage Evans be taken to satisfie his said Lordship of the fine af.d &c Whereupon the said Gamage Evans is Ordered to give Security to Save and keep Indemnifyed the Justices of the County of Somerset and their Successors from all troubles burthens and Charges that might Accrew by means of the birth and maintainance and bringing up of the af.d Child &c Thereupon the said Gamage Evans with John Evans of Somerset County planter his Security ^both^ present herein Court in their proper persons acknowledged themselves Indebted unto his ^said^ Lordship the right Honourable the Lord proprietary of the province of Maryland in thirty pounds Curr.t money of their bodys goods or Chattles lands or tenements Severally to be made and levied to the use of the Inhabitants of the County of Somerset for the time being if it happen that the said Gamage Evans and John Evans their heirs Executors and Administrators or any or either of them doe not from time to time and at all times hereafter acquit discharge and save harmless as well the Justices of Somerset County |
