211 that Ceader post they ware to Run on a streight Line to a marked white oak near the fork of Tipquin Creek and further this deponant saith that when he sold his Right of the said Lands his Intent was to be from the said Ceader post to the white oak for that was what he Claimed and no further the deponant being further questioned on behalf of M.r Levin Dashiell defendent of the Ceader post had over any notches or marks on it which he answers there was no notches or marks on it and being further asked whether the Ceader post was set up ^be^fore he allenated Shirmans part to him or no to which he answers the post was set up first and further saith that there was no devision since the alienation was drawn between them and further this deponant saith that the said Shirman and he agreed that the said alienation should be agreeable to the said Ceader post his William W Vauhn mark The Deposition of George Scott aged Sixty two years or their abouts being Sworn on the holy Evangelist of almighty God deposeth and saith that some years ago he was at a devision between a Certain William Vohn and Thomas Shirman and the said Sherman and Vohn agreed and fixed on a place for a devision between them and accordingly then and there set up a Ceader post as a devision between them which is the same post mentioned in the deposition of W.m Vohn and being further asked by M.r Levin Dashiell defendent whether the Ceader post had any notches or marks on it to which he answers there was none as he Remembers and further saith not Geo Scott The Deposition of Joseph Bounds aged thirty six years or there abouts being worn on the holy Evangelist of almighty God deposeth and saith that some years ago by Request of one Thomas Shirman he this deponant and a Certain George Dashiell Came to settle a devision between him the said Shirman and a Certain William Vohn at which time was present a Certain George Scott and one Joseph Waills which as this deponant saith he understood was Chosen by the said William Vohn and then and there in their presence was set up a Ceader post as a devision between the said Shirman and said Vohn and from that post they were to Run on a streight Line to a marked scrub ^white^ Oak some small distance from Tipquin Creek and further this deponant saith to the best of his knowledge its the very post they set up and stands in the same place and is the post mentioned in the above depositions and this deponant being further asked whether there was any notches or markes on the said post to which he answers there was none as he Remembers Joseph Bounds We the Subscribers do herby Certifie that on the fifteenth day of September In |
