211 on the af.d Land Called Meeches Hope and Rich Swamp You first haveing taken your Oaths on the holy Evangelist of Almighty God According to Act of Assembly in such Case made and provided and there Cause to Come before you or any three or two of you all such evidences as shall be to you or any three or two of you Nominated by the said Complainant or def.t if any and that you or any three or two of you Examine them upon their Corporall oaths to be by you or any three or two of you administred on the holy Evangelist of almighty God in the presence of the Complainant or deft if any touching the or Remembrance of their knowledge or any thing that may Relate to the Cause af.d and that Reducing the severall depositions into writing you send the same together with this Commission under your or any three or two of your hands and seals to us to our County Court of Somerset with all Convenient speed Wittness Robert King Gent Chief Justice of our said Court the twenty second day of June Anno Dom one thousand seven hundred and forty And now to witt the third tuesday of November being the Seventeenth day of the same month Anno Dom one thousand seven hundred and forty one At a Court then held before his Lordships Justices at dividing Creek in and for the County of Somerset Came Day Scott and Abraham Cordery two of the Gentleman nominated in the above Commission and mad Return thereof endorsed with the Severall depositions thereto annexed in form Following August 16.th 1740 Then Came Day Scott and Abraham Caudry and was Qualified to execute the within Commission agreeable to act of assembly in such Case provided the day above before RKing 1731 The Deposition of William Vauhn aged fifty four years or there abouts being sworn on the holy Evangelist of almighty God deposeth and saith that he formerly owned the Lands Called meeches hope and Rich swamp and gave his bond to one Thomas Shurman who was to have have part of the said Land and when they Came to make the devision between them they Could not agree on the said devision so accordingly Chose men to divide the same which were these M.r George Dashiell Sen.r now decease Mr Joseph Waills now deceast M.r George Scott and M.r Joseph Bounds who are here present and this deponant saith that in the presence of the Gentleman af.d he the said Shirman and this deponant had a Ceder post set up as a devison between them and to the best of of his knowledge the post is now in the same place that it was the first day it was set up and from that |
