210 forty shillings and altho' the same to pay the af.d Benjamin the first day of July in the year of our Lord one thousand seven hundred forty and one and often since that time at Somerset County af.d was by the said William requested but the af.d two Sums of forty shillings each unto him the said William hetherto to pay hath altogether refused and still doth refuse Whereupon the same William says he is worse and hath damage to the value of ten pounds Curr.t money of Maryland and thereof he brings Suit &c Pledg.s &c J Doe & R Roe A Copy of the foregoing declaration was made and sent to be Served on the defendant in order for Speedy tryall Att which day here Came the af.d William Lockwood by Robert Jenckins Henry his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Benjamin Warrington whose body here at this day he had ready to Answer the af.d William Lockwood of the af.d plea as to him it was Commanded And further the said sheriffe returned that he had Served the af.d Benjamin Warrington with a Copy of the foregoing declaration According to Act of Assembly in such Case made and provided &c And the af.d Benjamin Warrington present herein Court in his proper person at the prayer of the af.d William Lockwood is adjudged to give speciall bail to the Action af.d Thereupon Came hereinto Court a Certain Robert Adkins of Somerset County planter in his proper person and undertook for the said Benjamin Warrington (Likewise the said Benjamin Warrington present herein COurt in his proper person and Assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for the same William Lockwood against the said Benjamin Warrington or that the same Benjamin Warrington should be therein Convict that then he the said Benjamin should pay and Satisfie unto the said William Lockwood the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the said Robert Adkins will doe the same for him &c And the af.d Benjamin Warrington by Francis Allen his Attorney Comes and defends the force and Injury when &c and prays a hearing of the Originall writt of the af.d William and to him it is read in these words Somerset County ss Charles Absolute Lord and proprietary of the provinces of Maryland and Avalon Lord Baron of Baltemore &c To the sheriffe or Somerset County Greeting we Command you that you take Benjamin Warrington late of Somerset County planter Carpenter if he shall be found in your bailywick and him safe keep so that you have his body before our Justices of our County Court of Somerset to be held at dividing Creek in the same County the third tuesday of August next to answer unto William Lockwood of a plea of trespass upon the Case &c hereof fail not at your perill and have you then and there this writt Wittness John Scott Gent one of our Justices of our said Court this Nineteenth day of June in the 27th year of our Dominion &c Anno Dom 1741 which being read and |
