be held at dividing Creek the third Tuesday of August Anno Dom one thousand seven hundred and forty one to Answer unto William Lockwood of a plea of trespass upon the Case &c And the same day is given to the af.d William here &c And hereupon the said William Lockwood Complained of the af.d Benjamin Warrington in the plea af.d in form Following Somerset ss Benjamin Warrington late of Somerset County Carpenter was Attached to Answer unto William Lockwood of a plea of trespass upon the Case &c And Whereupon the same William by Robert Jenckins Henry his Attorney Complains that whereas the af.d Benjamin after the first day of may in the year of our Lord one thousand seven hundred and five (to witt) the first day of may in the year of our Lord one thousand seven hundred and forty one at SOmerset County did make his Certain Note in writing Called a promissory Note with his proper hand thereunto Subscribed bearing date the same day and year last above mentioned which said Note the af.d Benjamin to the af.d William then and there did deliver and by the same Note did promise to pay unto the said William by the name of William Lockwood or Order the sum of Eight pounds curr.t bills of Credit at three payments (to witt) forty Shillings thereof on or before the Eighth day of the then month of may and forty shillings more thereof at or before June Court then next Following and the four pounds residue to be paid the twenty ninth day of September next ensuing the date of the same note by reason of which premisses as also by force of the statute in such Case lately made and provided the same Benjamin became Chargeable to pay to the same William the af.d Eight pounds in the note af.d mentioned According to the form and Effect of the same note and so thereof Chargeable being the af.d Benjamin in Consideration thereof afterwards the same first day of May in the year of our Lord one thousand seven hundred forty and one at Somerset County af.d upon himself did assume and to the same William then and there faithfully promise to pay unto the same William the af.d Eight pounds in the note af.d mentioned agreeable to the tenor of that Note Nevertheless the af.d Benjamin his promise and Assumption af.d in form af.d made little regarding but minding and fraudulently intending the same William in that part Craftily and Subtilly to deceive and defraud the af.d Sum of forty shillings part of said Eight pounds on or before the Eighth day of may in the said note mentioned and the said forty shillings more of the said Eight pounds at or before June Court then next Following unto the said William hath not paid According to the tenor of the said Note nor any penny of either of the said last mentioned sums unto him hath paid by which Accrews to the said William to have and receive of the af.d Benjamin the af.d two Sums of forty |
