and Contrary to the peace &.a
                                                                            And Whereupon the said Thomas by Robert
Jenckins Henry his attorney Complains that whereas the af.d Andrew the second day of October
in the year of our Lord one thousand seven hundred and forty at Somerset County af.d the Close of him
the said Thomas Called Smithfield he did with force and arms break and enter and five hundred
Oak Timber Trees and five hundred Pine trees then and there lately growing he did Cut down
Split into Boards and Fence Rails and the same day did Carry away to the value of thirty pounds
Currt money of maryland and the soil of him the said Thomas the same Andrew then and there
dig up and plant and other Enormitys to him then and there did to the grievous damage of ^him^ the
same Thomas ^and Contrary to the peace &.a whereupon the same Thomas^ says he is worse and hath damage to the value of fifty pounds Currt money af.d
and thereof he brings suit &.a                                                 Pledges &.a J Doe & R Roe

                   A Copy of the foregoing decleration was made and sent to be served on the
deft in order for a speedy Tryall                  Att which day here Came the af.d Thomas Pollet
by his attorney af.d and the sheriffe to witt John Handy Gent now here Returned that he had
taken the af.d Andrew Wilson whose body hereat this day he had ready to answer the af.d Thomas
POllet of the af.d plea as to him it was Commanded and further the same sheriffe Returned that
he had served the af.d Andrew Wilson with a Copy of the foregoing decleration

                     And the af.d Andrew Wilson by William Arbuckle his attorny Comes and defends the
force and Injury when &.a and prayeth Leave thereof to Imparle here untill next Court to be
held at dividing Creek in and for the County af.d the third tuesday of August then next ^Following^ and he hath it
and the same day is given to the af.d Thomas here also &.a

                               Att which day here Came againe as well the af.d Thomas Pollet as the af.d
Andrew Wilson by their attorneys af.d and hereupon the said Andrew as before defends the force
and Injury when &.a and saith that he is in no sort Guilty of the trespass in the plantiffe
decleration mentioned in manner and form as the plantiffe above against him hath declared
and of this he puts himself upon the Country and the af.d Thomas in Like manner

                Therefore it is Commanded the sheriffe of Somerset County that he should Cause to Come
here before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the
third tuesday of November then next Following twelve &.a by whom &.a and who neither &.a to Recognize &.a
