208 pleaded and the matter in the same Contained is in sufficient in Law to abate the Writt af.d and that he to that plea in manner and form af.d pleaded hath no necessity nor by the Law of the Land is held to Answer and this he is ready to verify Wherefore for want of a Sufficient Answer un that part the same Thomas prays Judgment and that the writt af.d be adjudged good &c And Whereupon the af.d Wilson McDorman prays leave thereof to Imparle here untill next Court to be held at dividing Creek the third Tuesday of November ^then^ next Following and he hath it and the same day is given to the af.d Thomas Sanders here also &c Att which day here Came again the af.d Wilson McDorman in his proper person and the said Thomas Sanders altho' Solemnly Called Came not nor ^is^ his writt af.d against the af.d Wilson McDorman further prosecuted &c Therefore it is Considered that the af.d Thomas Sanders take nothing by his writt af.d but be thereof in mercy for his false Clamor and that the af.d Wilson goe thereof without day &c
Creek the third tuesday of June Anno Dom one thousand seven hundred and forty one to answer unto Thomas Pollet of a plea wherefore with force and arms the Close of him the said Thomas at Somerset County af.d he did break and enter and five hundred oak Timber Trees and five hundred Pine Trees thereon lately growing he did Cut down split into boards and fence Rails and the same did Carry away to the value of thirty Pounds and the soil thereof did dig up and plant and other Enormitys to him then and there did to the Grevious damage of the said Thomas and Contrary to the peace &.a And the same day is given to the af.d Thomas here &.a And hereupon the said Thomas Pollet Complained of the af.d Andrew Wilson in the plea af.d in form Following Somerset ss Andrew Wilson late of Somerset County Planter was attached to answer unto Thomas Pollet of a plea wherefore with force and arms the Close of him the said Thomas at Somerset County af.d he did break and Enter and five hundred Oak Timber Trees and five hundred Pine Trees thereon lately growing he did Cut down split into Boards and fence Rails and the same did Carry away to the value of thirty Pounds and the soil thereof did dig up and plant and other Enormitys to him then and there did to the grievous damage of the said Thomas and |
