207 the same Thomas in that part Craftily and Suttlely to deceive and defraud the af.d sum of Two pounds fourteen shills and nine pence or any penny thereof unto the said Thomas altho' the same to do the said Wilson afterwards (to witt) the same day and year last above mentioned and often since that time at Somerset County af.d by the same Thomas was requested hath not paid or him for the same in any Sort Contented but the same to him hetherto to pay or Content hath altogether refused and still doth refuse whereupon the same Thomas says he is worse and hath damage to the value of five pounds Curr.t money of the province of Maryland and thereupon he brings Suit &c Pledg.s &c J Doe R Roe A Copy of the foregoing declaration was made and sent to be served in on the defendant in order for a speedy tryall Att which day here Came the af.d Thomas Sanders by Robert Jenckins Henry his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Wilson McDorman whose body hereat this day he had ready to Answer the af.d Thomas Sanders of the af.d plea as to him it was Commanded And further the said sheriffe returned that he had Served the af.d Wilson McDorman with a Copy of the foregoing declaration According to Act of Assembly in such Case made and provided &c And the af.d Wilson McDorman present herein Court in his proper person at the prayer of the af.d Thomas Sanders is Adjudged to give Speciall bail to the Action af.d Thereupon Came hereinto Court a Certain James Noble of Somerset County planter in his proper person and undertook for the said Wilson McDorman (Likewise the said Wilson McDorman should be therein Convict that then he the said Wilson should pay and satisfie unto the said Thomas Sanders the Judgem.t of the Court thereupon or render his body in Execution of Such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the said James Noble will doe the same for him &c And Wilson Dorman in his proper person Comes and says that he is the same person ag whom the af.d Thomas Sanders brought his writ af.d by the name of Wilson McDorman and defends the force and injury when &c And saith that he is Called and known by the name of Wilson Dorman and not by the name of Wilson McDorman as by the writ af.d it is Supposed and this he is ready to Verifie whereupon the same Wilson Dorman prays Judgment of the writ af.d &c And Whereupon the af.d Thomas Sanders prays leave thereof to Imparle here untill next Court to be held at dividing Creek the third Tuesday of August then next Following and he hath it and the same day is given to the af.d Wilson McDorman here also &c Att which day here Came the af.d Thomas Sanders by his Attorney af.d as the af.d Wilson McDorman in his proper person And the af.d Thomas Sanders says that the plea af.d of the af.d Willson in Abatement of the Writt af.d above |
