199 day and year af.d at the County af.d on Consideration thereof upon himself did assume and to the said John then and there faithfully promise that he the said Francis the said quantity of five thousand pounds of tobacco when he should afterwards be thereto required he would faithfully pay and Content Nevertheless the said Francis his promise and assumption af.d in form af.d made not regarding but minding and fraudulently intending the said John in that part Craftily and Subtilly to deceive and defraud the said five thousand pounds of tobacco to the said John hath not paid or him for the same in any Sort Contented but that to doe hitherto altogether hath refused and still doth refuse altho' thereto afterwards to wit on the day and year af.d at the County af.d and often since that time by the said John required whereupon the said John says he is damnified one hundred pounds Curr.t money of Maryland and thereof he prays of &c Pledg.s &c John Doe & R Roe And the said Francis Allen in his proper person Comes and defends the force and Injury when &c and prays leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third tuesday of March Anno Dom one thousand seven hundred and forty and he hath it and the same day is given to the af.d John here also &c Att which day here Came again as well the af John Purnall by his Attorney af.d as the af.d Francis Allen in his proper person and whereupon the af.d Francis Allen prayeth further leave thereof to Imparle hereuntill next Court to be held at dividing Creek in and for the County af.d the third tuesday of June then next Following and he hath it and the same day is given to the af.d John here also &c Att which day here Came again as well the af.d John Purnall by his Attorney af.d as the af.d Francis Allen in his proper person and whereupon the af.d Francis Allen prayeth further leave thereof to Imparle hereuntill next Court to be held at dividing Creek in and for the County af.d the third tuesday of August then next Following and he hath it and the same day is given to the af.d John here also &c Att which day here Came again as well the af.d John Purnall by his Attorney af.d as the af.d Francis Allen in his own proper person and whereupon the af.d Francis Allen prays further leave thereof to Imparle hereuntill next Court to be held at dividing Creek in and for the County af.d the third tuesday of November then next Following and he hath it and the same day is given to the af.d John here also &c Att which day here Came again as well the af.d John Purnall by his Attorney af.d as the af.d Francis Allen in his proper person and whereupon the said Francis Allen as before defends the force and Injury when &c And saith that he did not assume upon himself in manner and form as the said John above against him hath Complained and of this he puts himself upon the Country And the said John Purnall in like manner Therefore it is Commanded the Sheriff that Immediately he should Cause to Come here before his Lordships Justices Twelve &c by whom &c and who nither &c to recognize &c because as well &c and the Jurors of that Jury being Called Came some of them to witt John Woolford George Tull Ephraim Waggaman William Nelson Moses Mills and William Gray Came and were Sworn upon that Jury and because the residue of the Jurors of that |
