of tobacco in the Account of the said John Charged against him the said Francis the said John his action af.d
against him the said Francis Thereupon to have and maintain he ought not because he saith that he the
said Francis as to the sum of tobacco or any pt thereof did not assume upon himself at any time within
three Years next before the fileing of the bill af.d of him the said John against him the said Francis and
this he is ready to Verifie  Wherefore he prays Judgment if the said John his action af.d thereupon against
him the said Francis to have and maintain he ought &.a  and as to the sum of Two pounds twelve shillings
and Six pence Residue of the said Account ^in the said account^ Charged by the said John against him the said Francis the
said Francis says that he did not assume upon himself in manner and form af.d as the said John
above against him hath Complained and of this he puts himself upon the Country &.a

                      And Whereupon the said John Dennis by his attorney af.d pray Leave thereof to
Imparle here unto untill the next Court to be held at dividing Creek in and for the County af.d the third
tuesday of June then next Following and he hath it and the same day is given to the af.d Francis
here also &.a           
                                                                         Att which day here Came againe as well the af.d
John Dennis Ju.r by his attorney af.d as the af.d Francis Allen in his own proper person and hereupon
the said John Dennis Jun.r prayeth further Leave thereof to Imparle here untill next Court
to be held at dividing Creek in and for the County af.d the third tuesday of August then next Following
and he hath it and the same day is given to the af.d Francis here also &.a

                      Att which day here Came againe as well the af.d John Dennis Jun.r by his attorney
af.d as the af.d Francis Allen ^in^ his own proper person and hereupon the said John Dennis Jun.r
prayeth further Leave thereof to Imparle here untill next Court to be held at deviding Creek in
and for the County af.d the third tuesday of November then next Following and he hath it and
the same day is given to the af.d Francis here also &.a

             Att which day here Came againe as well the af.d John Dennis J.r by his attorney af.d as
the af.d Francis Allen in his own proper person  And Whereupon the said John Dennis and
Francis Allen Submitted their dispute in this action to the Arbitrament and final Determination
of George Dashiell James Martin and Henry Ballard of Somerset County Gentlemen or any
two of them and it is agreed by and between the plantiffe and defendent af.d that the af.d arbitrators
Return their arbitrament from under their or any two of their hands and seals Immediate to His
Lordships Justices in Court now here Judicially sitting and that the Court may proceed thereon
