hath Payed and satisfied to the same John three thousand two hundred and thirty nine pounds of tobacco
Nevertheless the af.^d Francis his promise and assumption af.^d as to Seven thousand nine hundred
and twenty five pounds of tobacco Residue and two pounds Twelve shillings and six pence lettle regarding
but plotting and fraudulently Intending the same John in this part Craftilly and Subtilly to deceive
and defraud the af.^d Seven thousand nine hundred and twenty five pounds Residue of the af.^d
Eleven thousand one hundred and Sixty four pounds of tobacco and two pounds twelve shillings
and six pence af.^d to the same John hath not paid but the same to pay hath hetherto altogether
Refused and still doth Refuse altho' by the same John on the Eighteenth day of March In
the year af.^d and often since the said Francis was Required Whereupon the same John saith
he is damnifyed two hundred pounds Currt money of maryland and thereof he brings suit &.^c

                                           And the af.^d Francis Allen ^in^ his own properson Comes and defends the force
and Injury when &.^c and prays Leave thereof to Imparle here untill next Court to be held at deviding
Creek in and for the County af.^d the third tuesday of March then next Following and he
hath it and the same day is given to the af.^d John here also &.^a

                      Att which day here Came againe as well the af.^d John Dennis Jun.^r by his attorney af.^d
as the af.^d Francis Allen In his proper person and hereupon the said Francis Allen as before defends
the force and Injury when &.^a and Protesting that he the said Francis never did assume upon himself
in manner and form as the said John above against him hath Complained for plea Nevertheless
the said Francis Allen saith that as to the sum of Eleven thousand One hundred and Sixty four pounds
