197 there depending between Robert Smith and Daniel Cordery wee do award and decree that the said Daniel Cordery shall pay unto the said Robert Smith twenty seven pounds seven shillings and Eight pence Curr.t money of the province of Maryland with the legal Costs of the said suit now in Letigation in the said County Court of Somerset and that upon payment of the af.d Sum and Costs the same Robert and Daniel shall Execute General releases to each other Rob.t Jenckins Henry George Douglas Which being read and heard and by the Court here fully understood it is Considered by William Arbuckle the Court here that the af.d Robert Smith recover against the af.d Daniel Cordery his damages af.d to the af.d twenty seven pounds seven shillings and Eight pence Curr.t money of Maryland by the arbitrators af.d in form af.d Assessed as also 428 pounds of tobacco for his Costs and Charges af.d to the same Edward Robert by the Court now here of his Assent adjudged and the af.d Daniel in mercy &c
the peace for the County to Conserve assigned &.a in Court Judicially Sitting Came John Dennis Jun.r by William Arbuckle his attorney and Exhibeted to the said Justices his Certain Bill against Francis Allen Gent one of the attornies of this Court herein Court present in his proper person the tenor whereof as Followeth Somerset ss John Dennis Jun.r by William Arbuckle his attorney Complains of Francis Allen one of the attornies of this Court herein Court present in his proper person for that whereas the said Francis on the Seventeenth day of march Anno Dom Seventeen hundred and thirty eight at the County af.d was Indebted to the said John in the Quantity of Eleven thousand One hundred and Sixty four pounds of tobacco and two pounds twelve shillings and six pence Currt money of maryland for sundry things properly Chargeable in account as by an account thereof hereto annexed may appear an being so thereof Indebted afterwards to witt the day and year af.d at the County af.d upon himself did assumed and to the same John then and there faithfully promised that he the said Francis the af.d Eleven thousand One hundred and Sixty four pounds of tobacco and two Pounds twelve shillings and Six pence to the same John when he should be thereto Afterwards Required he would faithfully pay and Content and Altho' the said Francis since his promise and assumption hath |
