196 Whereupon the af.d Daniel Cordery puts in his place Robert Jenckins Henry Gent Attorney at Law against the af.d Robert Smith of the af.d plea &c And thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek in and for the County af.d the third Tuesday of March then next Following in the same state as at present saveing to the parties af.d &c Att which day here Came again as well the af.d Robert Smith as the af.d Daniel Cordery by their Attorneys af.d and hereupon the said Robert Smith Complained of the af.d Daniel Cordery in the plea af.d in form Following Somerset ss Daniel Cordery late of Somerset County planter was attached to answer unto Robert Smith of a plea of trespass upon the Case &c And Whereupon the said Robert by George Douglas his Attorney Complains that whereas the said Robert on the fourteenth day of february Anno Dom MDCCXXViii at the County Sussex viz at Somerset County af.d at the Especiall request and Instance of the said Daniel Cordery did together with the said Daniel by their Joint and Severall writings obligatory Sealed with their Seals become bound unto a Certain Thomas Bell in his life in the sum of Sixty Seven pounds fifteen shillings and two pence Currt money of pensilvania of the value of one hundred and twenty pounds Currt money of Maryland with Condition to the said writing that the said Daniel and Robert or one of them should pay to the said Thomas the sum of thirty three pounds Seventeen shillings and Seven pence Currt money of maryland ^being^ of the value of Sixty pounds Curr.t money of Maryland at or before the tenth day of may next Ensuing the date of the said writing he the said Daniel on Consideration thereof afterwards to wit on the day and year first mentioned at Somerset County af.d upon himself did assume and to the said Robert then and there faithfull promise that he the said Daniel the sum of money in the Condition of the said obligation mentioned According to the tenor of that Condition would faithfully pay and that he would Indemnify the said Robert by means of his so becoming bound as af.d Nevertheless the said Daniel his promise af.d in form af.d made not regarding but minding and fraudulently intending the said Robert in that part Craftily and Subtilly to deceive and defraud the said Sum in the Condition of the said obligation mentioned According to the tenor of the said Condition did not pay by means whereof the said Robert after the death of the said Thomas Bell afterwards to wit on the day of Anno Dom was impleaded in the County Court of Sussex af.d at Lewes viz.t at Somerset County af.d by William Craig and Mary his wife Executrix of the testament and last will of the said Thomas and on that plea afterwards to wit on the day of Anno Dom the said William Craig and Mary his wife recovered against the af.d Robert Smith by the Consideration of the said Court as well the debt of Sixty Seven pounds fifteen shillings and two pence Curr.t money of pensilvania of the value af.d as the sum of Curr.t money of Pensilvania of the value of Curr.t money of Maryland being for their Damages for detaining the said Debt and their Costs by them in the plea af.d |
