196 Return of their arbitrament in the premisses af.d Between the parties af.d in manner Following Edward Beachamp Plantiffe and Burnall Niblett defendent haveing submitted their Suit now depending before the Worshipfull Justices of Somerset to us the subscribers according to the Statute we therefore award and decree the af.d Deft to pay to the said Plantiff Fifteen Shillings Currt money of maryland with his Costs November 21.t 1741 Robt Jenckins Henry W.m Arbuckle Which being Read and heard and by the Court here fully understood It is Considered by the Court here that the af.d Edward Beachamp Recover against the af.d Burnall Niblett his damages af.d to the af.d fifteen Shillings Currt money of maryland by the arbitrators af.d in form af.d 263 assessed as also Pounds of tobacco for his Costs and Charges af.d to the same Edward by the Court now here of his assent adjudged and the af.d Burnall in Mercy &.a
unto Robert Smith of a plea of trespass upon the Case &c And the same day is given to the af.d Robert here &c Att which day here Came the af.d Robert Smith by George Douglas his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Daniel Cordery whose body hereat this day he had ready to Answer the af.d Robert Smith of the af.d plea as to him it was Commanded And the af.d Daniel Cordery being present herein Court in his proper person at the prayer of the af.d Robert Smith by his Attorney af.d is adjudged to give Speciall bail to the Action af.d Thereupon Came hereinto Court a Certain John Evans of Somerset County planter in his proper person and undertook for the said Daniel Cordery (Likewise the said Daniel Cordery present herein Court in his proper person Assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for the same Robert Smith against the said Daniel Cordery or that he the said Daniel should be therein Convict that then he the said Daniel should pay and satisfie unto the said Robert Smith the Judgment of the Court thereupon or render his body in Execution of such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the said John Evans will do the same for him &.a Whereupon |
