195 Maryland then and there being he the same Burnall did then and there ^take^ burn and destroy and other harms to the same Edward then and there did to the Grevious damage of the same Edward and Contrary to the Peace &.a Whereupon he says ^that^ he is damnifyed worse and hath damage to the Value of Twenty pounds Currt money of the Province of Maryland and thereof he brings suit &.a Pledges &.a J Doe and R Roe And the af.d Burnall Niblett by his attorney af.d Comes and defends the force and Injury When &.a and prayeth Leave thereof to Imparle here untill next Court to be held at dividing Creek the third tuesday of June then next Following and he hath it and the same day is given to the af.d Edward here also &.a Att which day here Came againe as well the af.d Edward Beachamp as the afd Burnall Niblett by their attorneys af.d and hereupon the said Burnall Niblett as before defends the force and Injury when &.a and saith that he is not Guilty of the trespass in manner and form as the plantiffe above against him hath Complained and of this he puts himself upon the Country &.a And hereupon the af.d Edward Beachamp prays Leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third tuesday of August ^then next Following^ and he hath it and the same day is given to the af.d Burnall Niblett here also &.a Att which day here Came againe as well the af.d Edward Beachamp as the af.d Burnall Niblett by their attorney af.d And Whereupon the plantiffe and defendent by their said Attorneys submitted their dispute in his action to the arbitrament and final Determination of William Arbuckle and Robert Jenckins Henry of Somerset County Gentleman and it is agreed by and between the parties af.d that the af.d Arbitrators Return their Arbitrament in writing under their hands and seals to the Justices of his Lordships County Court of Somerset to be held at dividing Creek in and and for the County af.d the third tuesday of November then next Following that the same Justices may proceed thereon to Judgment against Either of the parties af.d ^as^ if the Cause were determined by the Court and it is further agreed by the parties af.d that that Submission af.d be made a Rule of this Court Therefore it is Ordered that the Submission af.d in manner and form af.d made according to the form and Effect of the statute in that Case lately made and provided be entred and made a Rule of this Court on the motion of the parties af.d and the same day is given to the parties af.d here &.a Att which day here Came againe the plantiffe and ^Defendent^ and hereupon William Arbuckle and Robert Jenckins Henry the Gentlemen mentioned in the above Rule of Submission Likewise Came and made Return |
