                  November Court                           1741                       195

third tuesday of November Anno Dom one thousand seven hundred and forty to answer unto Edward
Beachamp of a plea wherefore with force and arms at Somerset County af.d the Close of him the said
Edward he did Break and enter and one Tarr kiln thereon did Erect and the Light wood of him the
said Edward there being to the value of Ten pounds Currt money of maryland he did take burn and
distroy and other harms to him it did to the grevious damage of him the said Edward Contrary to the
Peace of the Right Honourable the Lord Proprietary that now is &.a  and the same day is given to
the af.d Edward here &.a

                      Att which day here Came the af.d Edward Beachamp by Robert Jenckins Henry his
attorney and the sheriffe to witt John Handy Gent now here Returned that he had taken the af.d
Burnall Niblett whose body hereat this day he had ready to answer the af.d Edward Beachamp
of the af.d plea as to him it was Commanded

                  Whereupon the af.d Burnall Niblett puts in his place William Arbuckle Gent Attorney
at Law against the af.d Edward Beachamp of the af.d plea &.a

               And Thereupon at the Request of the parties af.d day is to them now here given untill
next Court to be held at dividing Creek in and for the County af.d the third tuesday of March then next
Following in the same state as at present saveing to the parties af.d &.a

                   Att which day here Came againe as well the af.d Edward Beachamp as the af.d Burnell
Niblett by their attorneys af.d and hereupon the said Edward Beachamp Complained of the af.d
Burnall in the plea af.d in form Following
                                                                      Somerset ss   Burnall Niblett late of Somerset
County Planter was attached to answer unto Edward Beachamp of a plea wherefore with force
and arms at Somerset County af.d the Close of him the same Edward he did break and Enter and
One Tarr kiln thereon did Erect and the Light wood of him the said Edward there being to the
value of Ten pounds Curt money of maryland he did take burn and distroy and other harms to
him did to the Grevious damage of him the said Edward Contrary to the peace of the right Honourable the
Lord Proprietary that now is &.a

                                     And Whereupon the same Edward by Robert Jenckins Henry his
attorny Complains that the af.d Burnall the            day of            In the year of our Lord
One thousand seven hundred and forty with force and arms &.a the Close of him the same Edward Called
Led Bourn at Somerset County af.d he did Break and enter and one Tarr kiln thereon did Erect and fifty
Cart Loads of the Light wood of him the said Edward of the value of Ten pounds Currt money of
