194 afterwards to wit the Same day and year af.d at the County af.d into the hands and possession of the said Daniel by finding Came Nevertheless the said Daniel altho' he knew the said Deer to be the proper Deer of the said Thomas and to him of right to belong the said Deer to the said Thomas did not deliver but the same Deer afterwards to wit the day and year af.d at the County af.d to his own proper use did Convert and dispose to the damage of the said Thomas five pounds Curr.t money of Maryland and thereof he brings Suit &c Pledg.s &.c J Doe & R Roe And the af.d Daniel Young by his Attorney af.d Comes and defends the force and Injury when &c and prayeth Leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third tuesday of June then next Following and he hath it and the same day is given to the af.d Thomas here also &c Att which day here Came again as well the af.d Thomas Newbold as the af.d Daniel young by their Attorneys af.d and whereupon the af.d Daniel Young prays further leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third tuesday of August then next Following and he hath it and the same day is given to the af.d Thomas here also &c Att which day here Came again as well the af.d Thomas Newbold as the af.d Daniel Young by their Attorney af.d and whereupon the af.d Daniel Young as before defends the force and Injury when &c And saith he is not Guilty of the premisses by the said Thomas above upon him imposed and of this he puts himself upon the Country &c And the said Thomas in like manner Therefore it is Commanded the sheriffe of the Somerset County that he should Cause to Come before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November then next Following twelve &c by whom &c and who nither &c to recognize &c because as well &c And the same day is given to the af.d parties here &c Att which day here Came again the af.d Daniel Young by his Attorney af.d but the same Thomas altho' Solemnly Called Cometh not nor ^is^ his writt af.d against the af.d Daniel further prosecuted Therefore it is Considered by the Court here that the af.d Thomas Newbold take noth by his writt af.d but that he and his pledges of prosecuting to witt John Doe and Richard Roe are in Mercy and that the af.d Daniel goe thereof without day and Also it is Considered that the af.d Daniel Young recover against the af.d Thomas Newbold 593 pounds of tobacco for his Costs and Charges by him about his defence af.d in that part Sustained by the Court now here adjudged According to the form of the statue in such Case thereof lately made and provided and the same Daniel have thereof Execution &c
