188 Alexander Buncle the aforesaid Fifty Eight Shillings and nine pence Currant money of Maryland in manner and form as the aforesaid Alexander Buncle above against him declared Therefore it ^is^ Considered that the aforesaid Alexander Buncle Recover against the aforesaid John Lambertson his debt aforesaid and his damages by Occasion of the detention of the same debt to 425 pounds of tobacco to the same Alexander Buncle of his assent by the Court here adjudged and the afd John in mercy &c
And Whereupon the said Isaac in his proper person says that whereas the said Duncan on the xxvif day of May Anno Dom MDCCXLF at the County of Somerset by his Certain writing Obligatory which the said Isaac Sealed with the Seal of the said Dunken here in Court brings whose date is the day and year af.d did acknowledge himself to be held and firmly bound unto the said Isaac in One hundred and thirty pounds Currt paper money of maryland to be paid to the said Isaac when he should be afterwards thereto Required and altho' the said Duncan hath paid to the said Isaac Twenty two pounds two shillings and nine pence in Gold of the value of thirty pounds Currt money af.d in paper Nevertheless the said Duncan the Residue of the said One hundred and thirty pounds Vizt One hundred pounds paper money af.d to the said Isaac hath not Rendred but that to doe altogether hath denyed and still doth deny and unjustly detain'd altho' thereto afterwards to witt on the first day of June in the year af.d at the County af.d and often since that time by the said Isaac Required to the damage of the said Isaac One hundred and thirty pounds Currt money of maryland and thereof he brings suit &.a Pledges &.a J Doe and R Roe And the af.d Duncan Murray by George Douglas his attorney Cometh and defendeth the force and Injury when &.a and saith that he Cannot deny the action af.d of the af.d Isaac Morris nor but that the writing obligatory af.d is the deed of the same Duncan Murray nor but that he owes the same Isaac Morris the af.d One hundred ^and thirty^ pounds Currt money of maryland in manner and form as the af.d Isaac Morris above against him hath declared Therefore it is Considered that the af.d Isaac Morris Recover against the af.d Duncan |
