187 to answer unto Alexander Buncle of a plea that he Render unto him Fifty Eight shillings and nine pence Currant money of Maryland which to him he Owes and unjustly he detaines &.c and the same day is given to the aforesaid Alexander here &.c And the said Alexander declared against the aforesaid John Lamberson in the plea afd in form following Sommerset ss John Lambertson Late of Sommerset County planter otherwise Called John Lambertson of Sommerset County planter was Summoned to answer unto Alexander Buncle of a plea that he render unto him fifty Eight Shillings and nine pence Currant money of Maryland which to him he Owes and unjustly detaines &c And Whereupon the said Alexander by George Douglas his attorney says that whereas the said John on the xvij day of July Anno Dom MDCCXXXIX at the County af.d by his Certain bill obligatory which the said Alexander Sealed with the seal of the said John hereinto Court brings whose date is the day and year af.d did Acknowledge himself to be held and firmly bound to the said Alexander in the sum of fifty Eight shillings and nine pence Curr.t money of maryland to be paid to the said Alexander at or before the twentyeth day of November then next Ensuing the date of that bill Nevertheless the said John the said fifty Eight shillings and nine pence to the said Alexander by the time last af.d did not render nor hath he the same or any part thereof to the said Allexander rendred hitherto but that to doe altogether hath denyed and still doth deny and unjustly detain altho' thereto afterwards to wit on the twenty first day of November in the year af.d at the County af.d and often since that time by the said Alex.a required to the damage of the said Alexander five pounds Curr.t money of Maryland thereof he brings Suit &.c Pledg.s &.c J Doe R Roe A Copy of the foregoing declaration was made and Sent to be served on the def.t in order for a Speedy Tryall Att which day here Came the af.d Allexander Buncle by his Attorney af.d and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d John Lamberson whose body hereat this day he had ready to answer the af.d Alex.a Buncle of the af.d plea as to him it was Commanded And further the same sheriffe returned that he had Served the af.d John Lamberson with a Copy of the foregoing declaration According to Act of Assembly in such Case made and provided &c Whereupon Came hereinto Court the aforesaid John Lambertson in his proper person and Thereupon the said John Lambertson at the prayer of the aforesaid Alexander Buncle is Adjudged to give Speciall Bail to the action aforesaid Whereupon Came here into Court a Certain Charles Penniwell of Sommerset County planter and undertook for the said John Lambertson (Likewise the said John Lambertson present here in Court in his proper person assumed upon himselfe) that if it should happen that Judgment in the plea afd should be rendered for the same Alexamder Buncle against him the same John Lambertson or that he the same John Lambertson should be therein Convict that then he the said John Lambertson should pay and satisfie unto the said Alexander Buncle the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the prison of the sheriffe of the County afd in satisfaction thereof or that he the said Charles Penniwell will do the same for him And the aforesaid John Lambertson by Robert Jenckins Henry his attorney Cometh and defendeth the force and Injury when &.c and saith that he Cannot deny the action aforesaid of the aforesaid Alexander Buncle nor but that the writing Obligatory aforesaid is the deed of the same John Lambertson nor but that he Owes the Same Alex.d |
