184 unjust Detains &c And Whereupon the same Onorio by Robert Jenckins Henry his Attorney says that whereas the af.d Thomas by his Certain writing obligatory bearing date the twenty fifth day of March in the year of our Lord one thousand seven hundred and forty at Somerset County did grant himself to be held and firmly bound unto the same Onorio in the af.d sum of fifty pounds sterling to be paid unto the same Onorio when thereof he should be requested Nevertheless the af.d Thomas altho' often requested the said Sum of money or any penny thereof unto the same Onorio he hath not paid rendred but the same to him to render hetherto hath gainsayed and still doth gainsay to the damage of the same Onorio twenty pounds Sterling and thereof he brings Suit &c And brings hereinto Court the Writing af.d which the debt af.d doth testify the date of which is the same day and year af.d &c Pledg.s &.c J Doe & R Roe A Copy of the foregoing declaration was made and sent to be Served on the def.t with the writt in order for a Speedy tryall Att which day here Came the af.d Onorio Rosalini by his Attorney af.d and the sheriffe to witt John Handy ^Gent^ now here returned that he had taken the af.d Thomas Chase whose body at this day he had ready to Answer the af.d Onorio Rosalini of the af.d plea as to him it was Commanded and further the same sheriffe returned that he had served the af.d Thomas with a Copy of the foregoing declaration According to Act of Assembly in such Case made and provided &c And the aforesaid Thomas ^Chase^ by George Douglas his attorney Comes and defends the force and Injury when &.a and the same attorney says that he is not Informed by the Same Thomas his Clyant of any answer for the Same Thomas to the aforesaid Rosalini in the plea aforesaid to be given and nothing els thereupon saith by which the same Rosalini Remaineth against the aforesaid Thomas Chase thereof undefended Therefore it is Considered that the aforesaid Rosalini recover against the aforesaid Thomas Chase his debt aforesaid and his damages by Occasion of the detention of the same debt to Three Hundred and Eighty 60 Two pounds of tobacco to the same Rosalini of his assent by the Court here adjudged and the aforesaid Thomas Chase in mercy &a
hundred and forty One to answer unto John Henry late sheriffe of the said County of Somerset of a plea of trespass upon the Case &.a and the same day is given to the af.d John Henry here &.a And the said John Henry declared against the af.d John M.ccClester in the plea af.d in form Following Somerset ss John M.ccClester late of Somerset County Planter was Attached to Answer unto John Henry late sheriffe of the said County of Somerset of a plea of Trespass upon the Case &.a And Whereupon the same John Henry by George Douglas his attorny Complains that whereas the af.d John M.ccClester the twenty fourth day of March In |
