180 184 him it was Commanded and further the same Sheriffe Returned that he had served the af.d Charles with a Copy of the foregoing decleration according to act of assembly in such Case made and provided &.a And the af.d Charles Penniwell in his own proper person Cometh and defendeth the force and Injury when &.a and saith that he Cannot deny the action af.d of the af.d John Henry nor but that he did assume upon himself in manner and form as the afd John Henry above against him Complained and as to the damage of the same John by him by occasion of the premisses in that part Sustained the same Charles saith and acknowledgeth that the af.d John hath sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to Two pounds fifteen Shillings and Eight pence Currt money of maryland and not more and because the af.d John denys not this but the same allagations grants to be true prays Judgment for those damages above acknowledged together with his Costs and Charges af.d to him to be adjudged &c Therefore by Consent of the parties af.d It is Considered that the af.d John Henry Recover against the af.d Charles Penniwell his damages af.d to the af.d Two pounds fifteen Shillings and and Eight pence Currt money of maryland by the same Charles in form af.d acknowledged 265 as also Pounds of tobacco for his Costs and Charges af.d to the same John at his Request by the Court now here of the assent of the parties af.d Adjudged which Certain damages in the whole amounts to Two pounds fifteen Shillings and Eight pence Currt money of maryland and Pounds of tobacco and the af.d Charles in Mercy &.a
dividing Creek the third Tuesday of November Anno Dom one thousand seven hundred and forty one to Answer unto Onorio Rosalini of a plea that he render unto him the sum of fifty pounds sterling which to him he owes and unjustly detains &c and the same day is given to the af.d Onorio here &c And the said Onorio Rosalina declared against the said Thomas Chase in the plea af.d in form Following Somerst ss/ Thomas Chase late of Somerset County Clark otherwise Called Thomas Chais of Somerset County in Maryland Clerk was Summoned to Answer unto Onorio Rosalini of a plea that he render unto him the sum of fifty pounds Sterling which to him he owes and unjustly |
